| 6 | 6 | | relating to the first day of the school year for public schools. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 25.0811, Education Code, is amended by |
|---|
| 9 | 9 | | amending Subsection (a) and adding Subsection (c) to read as |
|---|
| 10 | 10 | | follows: |
|---|
| 11 | 11 | | Sec. 25.0811 FIRST DAY OF INSTRUCTION. (a) Except as |
|---|
| 12 | 12 | | provided by this section, a school district may not begin |
|---|
| 13 | 13 | | instruction for students for a school year before the third |
|---|
| 14 | 14 | | [fourth] Monday in August. A school district may: |
|---|
| 15 | 15 | | (1) begin instruction for students for a school year |
|---|
| 16 | 16 | | before the third [fourth] Monday in August if the district operates |
|---|
| 17 | 17 | | a year-round system under Section 25.084; or |
|---|
| 18 | 18 | | (2) begin instruction for students for a school year |
|---|
| 19 | 19 | | on or after the first Monday in August at a campus or at not more |
|---|
| 20 | 20 | | than 20 percent of the campuses in the district if: |
|---|
| 21 | 21 | | (A) the district has a student enrollment of |
|---|
| 22 | 22 | | 190,000 or more; |
|---|
| 23 | 23 | | (B) the district at the beginning of the school |
|---|
| 24 | 24 | | year provides, financed with local funds, days of instruction |
|---|
| 25 | 25 | | required under Section 25.081; |
|---|
| 26 | 26 | | (C) the campus or each of the multiple campuses |
|---|
| 27 | 27 | | are undergoing comprehensive reform, as determined by the board of |
|---|
| 28 | 28 | | trustees of the district; and |
|---|
| 29 | 29 | | (D) a majority of the students at the campus or at |
|---|
| 30 | 30 | | each of the multiple campuses are educationally disadvantaged. |
|---|
| 31 | 31 | | (c) Notwithstanding Chapter 12A, Education Code, including |
|---|
| 32 | 32 | | Section 12A.003(b), a local innovation plan may not provide for the |
|---|
| 33 | 33 | | exemption of a district designated as a district of innovation from |
|---|
| 34 | 34 | | the first day of instruction requirement under this Section. |
|---|
| 35 | 35 | | SECTION 2. (a) Except as provided by Subsection (b) of |
|---|
| 36 | 36 | | this section, this Act applies beginning with the 2017-2018 school |
|---|
| 37 | 37 | | year. (b) Section 25.0811(c), Education Code, as amended by this |
|---|
| 38 | 38 | | Act, applies only to a local innovation plan adopted or renewed on |
|---|
| 39 | 39 | | or after the effective date of this Act. A local innovation plan |
|---|
| 40 | 40 | | adopted or renewed before the effective date of this Act is governed |
|---|
| 41 | 41 | | by the law in effect on the date the plan was adopted or renewed, and |
|---|
| 42 | 42 | | the former law is continued in effect for that purpose. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2017. |
