55 AN ACT
66 relating to the first day of the school year for public schools.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 25.0811, Education Code, is amended by
99 amending Subsection (a) and adding Subsection (c) to read as
1010 follows:
1111 Sec. 25.0811 FIRST DAY OF INSTRUCTION. (a) Except as
1212 provided by this section, a school district may not begin
1313 instruction for students for a school year before the third
1414 [fourth] Monday in August. A school district may:
1515 (1) begin instruction for students for a school year
1616 before the third [fourth] Monday in August if the district operates
1717 a year-round system under Section 25.084; or
1818 (2) begin instruction for students for a school year
1919 on or after the first Monday in August at a campus or at not more
2020 than 20 percent of the campuses in the district if:
2121 (A) the district has a student enrollment of
2222 190,000 or more;
2323 (B) the district at the beginning of the school
2424 year provides, financed with local funds, days of instruction
2525 required under Section 25.081;
2626 (C) the campus or each of the multiple campuses
2727 are undergoing comprehensive reform, as determined by the board of
2828 trustees of the district; and
2929 (D) a majority of the students at the campus or at
3030 each of the multiple campuses are educationally disadvantaged.
3131 (c) Notwithstanding Chapter 12A, Education Code, including
3232 Section 12A.003(b), a local innovation plan may not provide for the
3333 exemption of a district designated as a district of innovation from
3434 the first day of instruction requirement under this Section.
3535 SECTION 2. (a) Except as provided by Subsection (b) of
3636 this section, this Act applies beginning with the 2017-2018 school
3737 year. (b) Section 25.0811(c), Education Code, as amended by this
3838 Act, applies only to a local innovation plan adopted or renewed on
3939 or after the effective date of this Act. A local innovation plan
4040 adopted or renewed before the effective date of this Act is governed
4141 by the law in effect on the date the plan was adopted or renewed, and
4242 the former law is continued in effect for that purpose.
4343 SECTION 3. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2017.
