55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of protective services and the conduct of
88 certain investigations through the adult protective services
99 program of the Department of Family and Protective Services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 40.002(b), Human Resources Code, as
1212 effective September 1, 2017, is amended to read as follows:
1313 (b) Except as provided by Section 40.0025, the department
1414 shall:
1515 (1) provide protective services for children and
1616 elderly persons and persons with disabilities, including
1717 investigations of alleged abuse, neglect, or exploitation by a
1818 provider the department has authority to investigate under Section
1919 48.252 or under Section 261.404, Family Code [in facilities of the
2020 Department of State Health Services and the Department of Aging and
2121 Disability Services or the successor agency for either of those
2222 agencies];
2323 (2) provide family support and family preservation
2424 services that respect the fundamental right of parents to control
2525 the education and upbringing of their children;
2626 (3) license, register, and enforce regulations
2727 applicable to child-care facilities, child-care administrators,
2828 and child-placing agency administrators; and
2929 (4) implement and manage programs intended to provide
3030 early intervention or prevent at-risk behaviors that lead to child
3131 abuse, delinquency, running away, truancy, and dropping out of
3232 school.
3333 SECTION 2. Section 40.0025(b), Human Resources Code, is
3434 amended to read as follows:
3535 (b) In accordance with Subchapter A-1, Chapter 531,
3636 Government Code, and notwithstanding any other law, the department
3737 performs only functions, including the statewide intake of reports
3838 and other information, related to the following services:
3939 (1) child protective services, including services
4040 that are required by federal law to be provided by this state's
4141 child welfare agency;
4242 (2) adult protective services, including
4343 investigations conducted by adult protective services under
4444 Section 48.252 or under Section 261.404, Family Code [other than
4545 investigations of the alleged abuse, neglect, or exploitation of an
4646 elderly person or person with a disability:
4747 [(A) in a facility operated, or in a facility or
4848 by a person licensed, certified, or registered, by a state agency;
4949 or
5050 [(B) by a provider that has contracted to provide
5151 home and community-based services]; and
5252 (3) prevention and early intervention services
5353 functions, including:
5454 (A) prevention and early intervention services
5555 as defined under Section 265.001, Family Code; and
5656 (B) programs that:
5757 (i) provide parent education;
5858 (ii) promote healthier parent-child
5959 relationships; or
6060 (iii) prevent family violence.
6161 SECTION 3. Section 531.02011, Government Code, is amended
6262 to read as follows:
6363 Sec. 531.02011. PHASE TWO: FINAL TRANSFERS TO COMMISSION.
6464 On the dates specified in the transition plan required under
6565 Section 531.0204, the following functions are transferred to the
6666 commission as provided by this subchapter:
6767 (1) all functions of each state agency and entity
6868 subject to abolition under Section 531.0202(b) that remained with
6969 the agency or entity after the initial transfer of functions under
7070 Section 531.0201 or a transfer of administrative support services
7171 functions under Section 531.02012;
7272 (2) regulatory functions and functions related to
7373 state-operated institutions of the Department of State Health
7474 Services; and
7575 (3) regulatory functions of the Department of Family
7676 and Protective Services, other than regulatory functions of the
7777 department's adult protective services program involving
7878 investigations conducted under Section 48.252, Human Resources
7979 Code, or Section 261.404, Family Code.
8080 SECTION 4. Section 531.02013, Government Code, is amended
8181 to read as follows:
8282 Sec. 531.02013. FUNCTIONS REMAINING WITH CERTAIN AGENCIES.
8383 The following functions are not subject to transfer under Sections
8484 531.0201 and 531.02011:
8585 (1) the functions of the Department of Family and
8686 Protective Services, including the statewide intake of reports and
8787 other information, related to the following:
8888 (A) child protective services, including
8989 services that are required by federal law to be provided by this
9090 state's child welfare agency;
9191 (B) adult protective services, including
9292 investigations conducted by adult protective services under
9393 Section 48.252, Human Resources Code, or Section 261.404, Family
9494 Code [other than investigations of the alleged abuse, neglect, or
9595 exploitation of an elderly person or person with a disability:
9696 [(i) in a facility operated, or in a
9797 facility or by a person licensed, certified, or registered, by a
9898 state agency; or
9999 [(ii) by a provider that has contracted to
100100 provide home and community-based services]; and
101101 (C) prevention and early intervention services;
102102 and
103103 (2) the public health functions of the Department of
104104 State Health Services, including health care data collection and
105105 maintenance of the Texas Health Care Information Collection
106106 program.
107107 SECTION 5. This Act takes effect September 1, 2017.
