46 AN ACT
57 relating to a requirement that school districts and open-enrollment
68 charter schools report certain information regarding children with
79 disabilities who reside in residential facilities.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 29.012, Education Code, is amended by
1012 adding Subsection (c-1) to read as follows:
1113 (c-1) The commissioner by rule shall require each school
1214 district and open-enrollment charter school to include in the
1315 district's or school's Public Education Information Management
1416 System (PEIMS) report the number of children with disabilities
1517 residing in a residential facility who:
1618 (1) are required to be tracked by the Residential
1719 Facility Monitoring (RFM) System; and
1820 (2) receive educational services from the district or
1921 school.
2022 SECTION 2. This Act applies beginning with the 2017-2018
2123 school year.
2224 SECTION 3. This Act takes effect only if a specific
2325 appropriation for the implementation of the Act is provided in a
2426 general appropriations act of the 85th Legislature.
2527 SECTION 4. This Act takes effect immediately if it receives
2628 a vote of two-thirds of all the members elected to each house, as
2729 provided by Section 39, Article III, Texas Constitution. If this
2830 Act does not receive the vote necessary for immediate effect, this
2931 Act takes effect September 1, 2017.
