| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Section 29.012, Education Code, is amended by |
|---|
| 10 | 12 | | adding Subsection (c-1) to read as follows: |
|---|
| 11 | 13 | | (c-1) The commissioner by rule shall require each school |
|---|
| 12 | 14 | | district and open-enrollment charter school to include in the |
|---|
| 13 | 15 | | district's or school's Public Education Information Management |
|---|
| 14 | 16 | | System (PEIMS) report the number of children with disabilities |
|---|
| 15 | 17 | | residing in a residential facility who: |
|---|
| 16 | 18 | | (1) are required to be tracked by the Residential |
|---|
| 17 | 19 | | Facility Monitoring (RFM) System; and |
|---|
| 18 | 20 | | (2) receive educational services from the district or |
|---|
| 19 | 21 | | school. |
|---|
| 20 | 22 | | SECTION 2. This Act applies beginning with the 2017-2018 |
|---|
| 21 | 23 | | school year. |
|---|
| 22 | 24 | | SECTION 3. This Act takes effect only if a specific |
|---|
| 23 | 25 | | appropriation for the implementation of the Act is provided in a |
|---|
| 24 | 26 | | general appropriations act of the 85th Legislature. |
|---|
| 25 | 27 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 26 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 27 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 28 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 29 | 31 | | Act takes effect September 1, 2017. |
