| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 132.024(a)(2), Education Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (2) "Student information" means identifying |
|---|
| 13 | 13 | | information [in the commission's possession] regarding a |
|---|
| 14 | 14 | | student. The term includes: |
|---|
| 15 | 15 | | (A) a student's name, address, telephone number, |
|---|
| 16 | 16 | | social security number, e-mail address, or date of birth; |
|---|
| 17 | 17 | | (B) any other identifying number or other |
|---|
| 18 | 18 | | information that foreseeably could be combined with other publicly |
|---|
| 19 | 19 | | available information to reveal identifying information regarding |
|---|
| 20 | 20 | | the student; and |
|---|
| 21 | 21 | | (C) a student's education records, as defined by |
|---|
| 22 | 22 | | 34 C.F.R. Section 99.3. |
|---|
| 23 | 23 | | SECTION 2. Sections 132.024(b) and (c), Education Code, are |
|---|
| 24 | 24 | | amended to read as follows: |
|---|
| 25 | 25 | | (b) Student information in the possession of the commission |
|---|
| 26 | 26 | | or a career school or college is not public information for purposes |
|---|
| 27 | 27 | | of Chapter 552, Government Code. |
|---|
| 28 | 28 | | (c) Unless permitted by Subchapter F, Chapter 301, Labor |
|---|
| 29 | 29 | | Code, or commission rule: |
|---|
| 30 | 30 | | (1)[,] a person commits an offense if the person |
|---|
| 31 | 31 | | solicits, discloses, receives, or uses, or authorizes, permits, |
|---|
| 32 | 32 | | participates in, or acquiesces in another person's use of, student |
|---|
| 33 | 33 | | information in the commission's possession; and |
|---|
| 34 | 34 | | (2) a career school or college commits an offense if |
|---|
| 35 | 35 | | the career school or college discloses or disposes of student |
|---|
| 36 | 36 | | information in the career school or college's possession. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2017. |
