66 AN ACT
77 relating to the regulation of motor vehicle dealers, manufacturers,
88 and distributors.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 503.001, Transportation Code, is amended
1111 by amending Subdivisions (4) and (9) and adding Subdivision (10-a)
1212 to read as follows:
1313 (4) "Dealer" means a person who regularly and actively
1414 buys, sells, or exchanges vehicles at an established and permanent
1515 location. The term includes a franchised motor vehicle dealer, an
1616 independent motor vehicle dealer, an independent mobility motor
1717 vehicle dealer, [and] a wholesale motor vehicle dealer, and a
1818 manufacturer motor vehicle dealer.
1919 (9) "Independent motor vehicle dealer" means a dealer
2020 other than a franchised motor vehicle dealer, an independent
2121 mobility motor vehicle dealer, [or] a wholesale motor vehicle
2222 dealer, or a manufacturer motor vehicle dealer.
2323 (10-a) "Manufacturer motor vehicle dealer" means a
2424 manufacturer who, at an established and permanent location,
2525 regularly and actively buys, sells, or exchanges motor vehicles of
2626 a line make the manufacturer manufactures, distributes, or
2727 assembles.
2828 SECTION 2. Section 503.029(a), Transportation Code, is
2929 amended to read as follows:
3030 (a) An applicant for an original or renewal dealer general
3131 distinguishing number must submit to the department a written
3232 application on a form that:
3333 (1) is provided by the department;
3434 (2) contains the information required by the
3535 department;
3636 (3) contains information that demonstrates the person
3737 meets the requirements prescribed by Section 503.032;
3838 (4) contains information that demonstrates the
3939 applicant has complied with all applicable state laws and municipal
4040 ordinances;
4141 (5) states that the applicant agrees to allow the
4242 department to examine during working hours the ownership papers for
4343 each registered or unregistered vehicle in the applicant's
4444 possession or control; and
4545 (6) specifies whether the applicant proposes to be a:
4646 (A) franchised motor vehicle dealer;
4747 (B) independent motor vehicle dealer;
4848 (C) wholesale motor vehicle dealer;
4949 (D) motorcycle dealer;
5050 (E) house trailer dealer;
5151 (F) trailer or semitrailer dealer; [or]
5252 (G) independent mobility motor vehicle dealer;
5353 or
5454 (H) manufacturer motor vehicle dealer.
5555 SECTION 3. Section 503.036(a), Transportation Code, is
5656 amended to read as follows:
5757 (a) The holder of a franchised motor vehicle dealer's
5858 general distinguishing number or manufacturer motor vehicle
5959 dealer's general distinguishing number may buy, sell, or exchange
6060 new or used motor vehicles and reassign a manufacturer's
6161 certificate of origin, certificate of title, or other basic
6262 evidence of ownership of any type of vehicle owned by the dealer
6363 that the dealer is not otherwise prohibited by law from selling or
6464 offering for sale.
6565 SECTION 4. Section 2301.002(25), Occupations Code, is
6666 amended to read as follows:
6767 (25) "Nonfranchised dealer" means a person who holds
6868 an independent motor vehicle dealer's general distinguishing
6969 number, an independent mobility motor vehicle dealer's general
7070 distinguishing number, [or] a wholesale motor vehicle dealer's
7171 general distinguishing number, or a manufacturer motor vehicle
7272 dealer's general distinguishing number issued by the board under
7373 Chapter 503, Transportation Code.
7474 SECTION 5. Section 2301.252(a), Occupations Code, is
7575 amended to read as follows:
7676 (a) A person may not engage in the business of buying,
7777 selling, or exchanging new motor vehicles unless the person:
7878 (1) holds a franchised dealer's license issued under
7979 this chapter for the make of new motor vehicle being bought, sold,
8080 or exchanged;
8181 (2) holds a manufacturer motor vehicle dealer's
8282 general distinguishing number issued by the board under Chapter
8383 503, Transportation Code; or
8484 (3) [(2)] is a bona fide employee of:
8585 (A) the holder of a franchised dealer's license;
8686 or
8787 (B) the holder of a manufacturer motor vehicle
8888 dealer's general distinguishing number issued by the board under
8989 Chapter 503, Transportation Code.
9090 SECTION 6. Section 2301.476, Occupations Code, is repealed.
9191 SECTION 7. This Act takes effect September 1, 2017.
