511 A BILL TO BE ENTITLED
612 AN ACT
713 relating to establishment of the immigration authority delegation
814 training grant program for local law enforcement agencies.
915 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1016 SECTION 1. Subtitle B, Title 4, Government Code, is amended
1117 by adding Chapter 424 to read as follows:
1218 CHAPTER 424. IMMIGRATION
1319 Sec. 424.001. DEFINITION. In this chapter, "training
1420 program" means a training program operated by United States
1521 Immigration and Customs Enforcement for training local law
1622 enforcement officers to enforce federal immigration law. The term
1723 includes the immigration authority delegation program and the
1824 immigration authority delegation refresher training program
1925 established under Section 287(g) of the federal Immigration and
2026 Nationality Act (8 U.S.C. Section 1357(g)).
2127 Sec. 424.002. IMMIGRATION DELEGATION TRAINING GRANT
2228 PROGRAM FOR LOCAL LAW ENFORCEMENT. (a) The office of the governor
2329 shall develop and maintain a grant program that awards grants for
2430 the expenses incurred by a local law enforcement agency related to
2531 the attendance of a law enforcement officer of the agency in a
2632 training program.
2733 (b) A local law enforcement agency may apply to the office
2834 of the governor in the form and manner required by the office of the
2935 governor for a grant under the grant program established by this
3036 section. To qualify for a grant, an applicant must:
3137 (1) apply for preauthorization from the office of the
3238 governor before the law enforcement officer attends the training
3339 program; and
3440 (2) demonstrate that the law enforcement officer who
3541 will attend the training program:
3642 (A) is primarily engaged in making arrests; and
3743 (B) meets all of the United States Immigration
3844 and Customs Enforcement officer selection requirements required to
3945 attend the training program.
4046 Sec. 424.003. GRANT AMOUNT. If the application for a grant
4147 under the grant program established under this section is approved,
4248 the office of the governor shall issue a grant to the applicant in
4349 the amount of:
4450 (1) the salary of the law enforcement officer for:
4551 (A) four weeks, if the officer attends the basic
4652 training course under the training program; or
4753 (B) one week, if the officer attends the
4854 refresher course under the training program;
4955 (2) the costs incurred by the applicant because of the
5056 officer's absence while the officer is attending the training
5157 program, including overtime pay to another officer to fulfill the
5258 duties of the absent officer; and
5359 (3) other expenses the office of the governor
5460 considers necessary for the participation in the training program.
5561 SECTION 2. This Act takes effect only if a specific
5662 appropriation for the implementation of the Act is provided in a
5763 general appropriations act of the 85th Legislature.
5864 SECTION 3. This Act takes effect September 1, 2017.
