6	12		AN ACT
7	13		relating to establishment of the immigration authority delegation
8	14		training grant program for local law enforcement agencies.
9	15		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	16		SECTION 1. Subtitle B, Title 4, Government Code, is amended
11	17		by adding Chapter 424 to read as follows:
12	18		CHAPTER 424. IMMIGRATION
13	19		Sec. 424.001. DEFINITION. In this chapter, "training
14	20		program" means a training program operated by United States
15	21		Immigration and Customs Enforcement for training local law
16	22		enforcement officers to enforce federal immigration law. The term
17	23		includes the immigration authority delegation program and the
18	24		immigration authority delegation refresher training program
19	25		established under Section 287(g) of the federal Immigration and
20	26		Nationality Act (8 U.S.C. Section 1357(g)).
21	27		Sec. 424.002. IMMIGRATION DELEGATION TRAINING GRANT
22	28		PROGRAM FOR LOCAL LAW ENFORCEMENT. (a) The office of the governor
23	29		shall develop and maintain a grant program that awards grants for
24	30		the expenses incurred by a local law enforcement agency related to
25	31		the attendance of a law enforcement officer of the agency in a
26	32		training program.
27	33		(b) A local law enforcement agency may apply to the office
28	34		of the governor in the form and manner required by the office of the
29	35		governor for a grant under the grant program established by this
30	36		section. To qualify for a grant, an applicant must:
31	37		(1) apply for preauthorization from the office of the
32	38		governor before the law enforcement officer attends the training
33	39		program; and
34	40		(2) demonstrate that the law enforcement officer who
35	41		will attend the training program:
36	42		(A) is primarily engaged in making arrests; and
37	43		(B) meets all of the United States Immigration
38	44		and Customs Enforcement officer selection requirements required to
39	45		attend the training program.
40	46		Sec. 424.003. GRANT AMOUNT. If the application for a grant
41	47		under the grant program established under this section is approved,
42	48		the office of the governor shall issue a grant to the applicant in
43	49		the amount of:
44	50		(1) the salary of the law enforcement officer for:
45	51		(A) four weeks, if the officer attends the basic
46	52		training course under the training program; or
47	53		(B) one week, if the officer attends the
48	54		refresher course under the training program;
49	55		(2) the costs incurred by the applicant because of the
50	56		officer's absence while the officer is attending the training
51	57		program, including overtime pay to another officer to fulfill the
52	58		duties of the absent officer; and
53	59		(3) other expenses the office of the governor
54	60		considers necessary for the participation in the training program.
55	61		SECTION 2. This Act takes effect only if a specific
56	62		appropriation for the implementation of the Act is provided in a
57	63		general appropriations act of the 85th Legislature.
58	64		SECTION 3. This Act takes effect September 1, 2017.
