 A BILL TO BE ENTITLED
 AN ACT
 relating to regulation of steroid use by students participating in
 athletic competitions sponsored or sanctioned by the University
 Interscholastic League.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1.  The heading to Section 33.091, Education Code,
 is amended to read as follows:
 Sec. 33.091.  REGULATION [PREVENTION] OF [ILLEGAL] STEROID
 USE; RANDOM TESTING.
 SECTION 2.  Section 33.091, Education Code, is amended by
 amending Subsection (h) and adding Subsections (i), (j), (k), and
 (l) to read as follows:
 (h)  Except as provided by Subsection (i), Subsection (b)(1)
 does not apply to the use by a student of a steroid that is
 dispensed, prescribed, delivered, and administered by a medical
 practitioner for a valid medical purpose and in the course of
 professional practice, and a student is not subject to a period of
 ineligibility under Subsection (d)(6) on the basis of that steroid
 use. A student to whom this subsection applies must, at a time
 determined by the league, notify the league of the steroid use using
 a form approved by the league. The form must include consent to:
 (1)  the release to the league of the student's
 health-related information relevant to the student's steroid use;
 and
 (2)  communication between the league and the student's
 health care practitioners regarding the student's steroid use.
 (i)  The league may declare a student ineligible for
 competition on the basis of steroid use described by Subsection (h)
 if the league determines that the safety of competing students or
 the fairness of a particular competition has been or will be
 substantially affected by the student's steroid use.
 (j)  The league may adopt rules regarding the use of steroids
 by students participating in an athletic competition sponsored or
 sanctioned by the league, including rules providing for sanctions
 and loss of eligibility for violation of league rules. The rules
 must provide a process for the league to determine that a student is
 in violation of this section or league rules.
 (k)  A league hearing regarding a student's use of steroids
 shall be conducted in a closed session.
 (l)  The following information is confidential and not
 subject to disclosure under Chapter 552, Government Code:
 (1)  health-related information obtained by the league
 under Subsection (h); and
 (2)  information in a record arising from the league's
 evaluation of a student's steroid use described by Subsection (h)
 that could identify the student.
 SECTION 3.  This Act takes effect immediately if it receives
 the vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2017.
