49 A BILL TO BE ENTITLED
510 AN ACT
611 relating to regulation of steroid use by students participating in
712 athletic competitions sponsored or sanctioned by the University
813 Interscholastic League.
914 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1015 SECTION 1. The heading to Section 33.091, Education Code,
1116 is amended to read as follows:
1217 Sec. 33.091. REGULATION [PREVENTION] OF [ILLEGAL] STEROID
1318 USE; RANDOM TESTING.
1419 SECTION 2. Section 33.091, Education Code, is amended by
1520 amending Subsection (h) and adding Subsections (i), (j), (k), and
1621 (l) to read as follows:
1722 (h) Except as provided by Subsection (i), Subsection (b)(1)
1823 does not apply to the use by a student of a steroid that is
1924 dispensed, prescribed, delivered, and administered by a medical
2025 practitioner for a valid medical purpose and in the course of
2126 professional practice, and a student is not subject to a period of
2227 ineligibility under Subsection (d)(6) on the basis of that steroid
2328 use. A student to whom this subsection applies must, at a time
2429 determined by the league, notify the league of the steroid use using
2530 a form approved by the league. The form must include consent to:
2631 (1) the release to the league of the student's
2732 health-related information relevant to the student's steroid use;
2833 and
2934 (2) communication between the league and the student's
3035 health care practitioners regarding the student's steroid use.
3136 (i) The league may declare a student ineligible for
3237 competition on the basis of steroid use described by Subsection (h)
3338 if the league determines that the safety of competing students or
3439 the fairness of a particular competition has been or will be
3540 substantially affected by the student's steroid use.
3641 (j) The league may adopt rules regarding the use of steroids
3742 by students participating in an athletic competition sponsored or
3843 sanctioned by the league, including rules providing for sanctions
3944 and loss of eligibility for violation of league rules. The rules
4045 must provide a process for the league to determine that a student is
4146 in violation of this section or league rules.
4247 (k) A league hearing regarding a student's use of steroids
4348 shall be conducted in a closed session.
4449 (l) The following information is confidential and not
4550 subject to disclosure under Chapter 552, Government Code:
4651 (1) health-related information obtained by the league
4752 under Subsection (h); and
4853 (2) information in a record arising from the league's
4954 evaluation of a student's steroid use described by Subsection (h)
5055 that could identify the student.
5156 SECTION 3. This Act takes effect immediately if it receives
5257 the vote of two-thirds of all the members elected to each house, as
5358 provided by Section 39, Article III, Texas Constitution. If this
5459 Act does not receive the vote necessary for immediate effect, this
5560 Act takes effect September 1, 2017.
