66 AN ACT
77 relating to the regulation of the conduct of certain counseling
88 professions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 501, Occupations Code, is
1111 amended by adding Section 501.0031 to read as follows:
1212 Sec. 501.0031. REFUSAL BASED ON RELIGIOUS BELIEF. (a) In
1313 this section, "psychological services" has the meaning assigned by
1414 Section 501.003.
1515 (b) A person who holds a license under this chapter may
1616 refuse to provide a psychological service to a person if providing
1717 the service would cause the license holder to violate a sincerely
1818 held religious belief.
1919 (c) A license holder who refuses to provide a psychological
2020 service to a person under Subsection (b) shall coordinate a
2121 referral of the person to a psychologist, marriage and family
2222 therapist, licensed professional counselor, chemical dependency
2323 counselor, or social worker, as appropriate, who agrees to provide
2424 the counseling or therapy service.
2525 (d) The board may not take disciplinary action against or
2626 impose an administrative penalty on a license holder based on the
2727 license holder's refusal to provide a psychological service under
2828 Subsection (b).
2929 (e) A person may not bring a cause of action against a
3030 license holder based on the license holder's refusal to provide a
3131 psychological service under Subsection (b).
3232 (f) This state or a political subdivision of this state may
3333 not penalize or withhold benefits, including tax exemptions,
3434 governmental contracts, or grants, from a license holder based on
3535 the license holder's refusal to provide a psychological service
3636 under Subsection (b).
3737 (g) A license holder's refusal to provide a psychological
3838 service under Subsection (b) is not conduct that constitutes an
3939 element of a criminal offense.
4040 SECTION 2. Subchapter A, Chapter 502, Occupations Code, is
4141 amended by adding Section 502.005 to read as follows:
4242 Sec. 502.005. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
4343 person who holds a license under this chapter may refuse to provide
4444 marriage and family therapy to a person if providing the therapy
4545 would cause the license holder to violate a sincerely held
4646 religious belief.
4747 (b) A license holder who refuses to provide marriage and
4848 family therapy to a person under Subsection (a) shall coordinate a
4949 referral of the person to a psychologist, marriage and family
5050 therapist, licensed professional counselor, chemical dependency
5151 counselor, or social worker, as appropriate, who agrees to provide
5252 the counseling or therapy service.
5353 (c) The board may not take disciplinary action against or
5454 impose an administrative penalty on a license holder based on the
5555 license holder's refusal to provide marriage and family therapy
5656 under Subsection (a).
5757 (d) A person may not bring a cause of action against a
5858 license holder based on the license holder's refusal to provide
5959 marriage and family therapy under Subsection (a).
6060 (e) This state or a political subdivision of this state may
6161 not penalize or withhold benefits, including tax exemptions,
6262 governmental contracts, or grants, from a license holder based on
6363 the license holder's refusal to provide marriage and family therapy
6464 under Subsection (a).
6565 (f) A license holder's refusal to provide marriage and
6666 family therapy under Subsection (a) is not conduct that constitutes
6767 an element of a criminal offense.
6868 SECTION 3. Subchapter A, Chapter 503, Occupations Code, is
6969 amended by adding Section 503.0031 to read as follows:
7070 Sec. 503.0031. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
7171 licensed professional counselor may refuse to provide a service
7272 within the practice of professional counseling to a person if
7373 providing the service would cause the counselor to violate a
7474 sincerely held religious belief.
7575 (b) A licensed professional counselor who refuses to
7676 provide a service to a person under Subsection (a) shall coordinate
7777 a referral of the person to a psychologist, marriage and family
7878 therapist, licensed professional counselor, chemical dependency
7979 counselor, or social worker, as appropriate, who agrees to provide
8080 the counseling or therapy service.
8181 (c) The board may not take disciplinary action against or
8282 impose an administrative penalty on a licensed professional
8383 counselor based on the counselor's refusal to provide a service
8484 under Subsection (a).
8585 (d) A person may not bring a cause of action against a
8686 licensed professional counselor based on the counselor's refusal to
8787 provide a service under Subsection (a).
8888 (e) This state or a political subdivision of this state may
8989 not penalize or withhold benefits, including tax exemptions,
9090 governmental contracts, or grants, from a licensed professional
9191 counselor based on the counselor's refusal to provide a service
9292 under Subsection (a).
9393 (f) A licensed professional counselor's refusal to provide
9494 a service under Subsection (a) is not conduct that constitutes an
9595 element of a criminal offense.
9696 SECTION 4. Subchapter A, Chapter 504, Occupations Code, is
9797 amended by adding Section 504.003 to read as follows:
9898 Sec. 504.003. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
9999 person who holds a license, registration, or certification under
100100 this chapter may refuse to provide chemical dependency counseling
101101 to a person if providing the counseling would cause the holder to
102102 violate a sincerely held religious belief.
103103 (b) A license, registration, or certificate holder who
104104 refuses to provide chemical dependency counseling to a person under
105105 Subsection (a) shall coordinate a referral of the person to a
106106 psychologist, marriage and family therapist, licensed professional
107107 counselor, chemical dependency counselor, or social worker, as
108108 appropriate, who agrees to provide the counseling or therapy
109109 service.
110110 (c) The department may not take disciplinary action against
111111 or impose an administrative penalty on a person who holds a license,
112112 registration, or certification based on the holder's refusal to
113113 provide chemical dependency counseling under Subsection (a).
114114 (d) A person may not bring a cause of action against a person
115115 who holds a license, registration, or certification based on the
116116 holder's refusal to provide chemical dependency counseling under
117117 Subsection (a).
118118 (e) This state or a political subdivision of this state may
119119 not penalize or withhold benefits, including tax exemptions,
120120 governmental contracts, or grants, from a license, registration, or
121121 certificate holder based on the holder's refusal to provide
122122 chemical dependency counseling under Subsection (a).
123123 (f) A license, registration, or certificate holder's
124124 refusal to provide chemical dependency counseling under Subsection
125125 (a) is not conduct that constitutes an element of a criminal
126126 offense.
127127 SECTION 5. Subchapter A, Chapter 505, Occupations Code, is
128128 amended by adding Section 505.0026 to read as follows:
129129 Sec. 505.0026. REFUSAL BASED ON RELIGIOUS BELIEF. (a) A
130130 social worker may refuse to provide a service within the practice of
131131 social work to a person if providing the service would cause the
132132 social worker to violate a sincerely held religious belief.
133133 (b) A social worker who refuses to provide a service to a
134134 person under Subsection (a) shall coordinate a referral of the
135135 person to a psychologist, marriage and family therapist, licensed
136136 professional counselor, chemical dependency counselor, or social
137137 worker, as appropriate, who agrees to provide the counseling or
138138 therapy service.
139139 (c) The board may not take disciplinary action against or
140140 impose an administrative penalty on a social worker based on the
141141 social worker's refusal to provide a service under Subsection (a).
142142 (d) A person may not bring a cause of action against a social
143143 worker based on the social worker's refusal to provide a service
144144 under Subsection (a).
145145 (e) This state or a political subdivision of this state may
146146 not penalize or withhold benefits, including tax exemptions,
147147 governmental contracts, or grants, from a social worker based on
148148 the social worker's refusal to provide a service under Subsection
149149 (a).
150150 (f) A social worker's refusal to provide a service under
151151 Subsection (a) is not conduct that constitutes an element of a
152152 criminal offense.
153153 SECTION 6. The change in law made by this Act applies only
154154 to conduct that occurs on or after the effective date of this Act.
155155 Conduct that occurs before the effective date of this Act is
156156 governed by the law in effect on the date the conduct occurred, and
157157 the former law is continued in effect for that purpose.
158158 SECTION 7. This Act takes effect September 1, 2017.
