66 AN ACT
77 relating to requirements for underground facility damage
88 prevention and safety.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 251.002(6), Utilities Code, is amended
1111 to read as follows:
1212 (6) "Excavator" means an individual who or legal
1313 entity [a person] that actually excavates or intends to excavate in
1414 this state.
1515 SECTION 2. Subchapter A, Chapter 251, Utilities Code, is
1616 amended by adding Section 251.0045 to read as follows:
1717 Sec. 251.0045. EXCAVATION BY SUBCONTRACTOR. A
1818 subcontractor who performs an excavation operation may not begin
1919 the excavation unless the subcontractor has complied with the
2020 requirements this chapter imposes on an excavator, regardless of
2121 whether the general contractor that hired the subcontractor has
2222 complied with the requirements.
2323 SECTION 3. Section 251.151, Utilities Code, is amended by
2424 amending Subsection (a) and adding Subsection (a-1) to read as
2525 follows:
2626 (a) Except as provided by Sections 251.155 and 251.156, an
2727 excavator [a person] who intends to excavate shall notify a
2828 notification center not earlier than the 14th day before the date
2929 the excavation is to begin [or later than the 48th hour before the
3030 time the excavation is to begin], excluding Saturdays, Sundays, and
3131 legal holidays. An excavator may not excavate:
3232 (1) before 8 a.m. on the third day after the date on
3333 which the excavator gives the notice, excluding Saturdays, Sundays,
3434 and legal holidays; or
3535 (2) after the 21st day after the date on which the
3636 excavator gives the notice, including Saturdays, Sundays, and legal
3737 holidays.
3838 (a-1) If markings made by an operator after notice is given
3939 under Subsection (a) for an excavation operation showing the
4040 location of underground facilities in the excavation area are no
4141 longer visible, are unclear, or are damaged, the excavator shall
4242 give another notice under Subsection (a) for the unfinished
4343 portions of the excavation operation.
4444 SECTION 4. Sections 251.157(a) and (d), Utilities Code, are
4545 amended to read as follows:
4646 (a) Each Class A underground facility operator contacted by
4747 the notification system shall mark the approximate location of its
4848 underground facilities at or near the site of the proposed
4949 excavation if the operator believes that marking the location is
5050 necessary. The operator shall mark the location not later than:
5151 (1) 8 a.m. on the third day following the date on which
5252 the excavator gives to the notification system notice of intent to
5353 excavate under Section 251.151(a) [the 48th hour after the time the
5454 excavator gives to the notification system notice of intent to
5555 excavate], excluding Saturdays, Sundays, and legal holidays;
5656 [(2) 11:59 a.m. on the Tuesday following a Saturday
5757 notification unless the intervening Monday is a holiday;
5858 [(3) 11:59 a.m. on the Wednesday following a Saturday
5959 notification if the intervening Monday is a holiday;] or
6060 (2) [(4)] a time agreed to by the operator and the
6161 excavator.
6262 (d) Not later than 8 a.m. on the third day following the date
6363 on which the excavator gives to the notification system notice of
6464 intent to excavate under Section 251.151(a), excluding Saturdays,
6565 Sundays, and legal holidays [the 48th hour after the time the
6666 excavator gives to the notification center notice of intent to
6767 excavate], an operator contacted by the notification center shall
6868 notify the excavator of the operator's plans to not mark the
6969 proximate location of an underground facility at or near the site of
7070 the proposed excavation. The operator must provide the
7171 notification by e-mail or facsimile or by another verifiable
7272 electronic method approved by the board.
7373 SECTION 5. Section 251.151(b), Utilities Code, is repealed.
7474 SECTION 6. This Act takes effect September 1, 2017.
