77 relating to the requirements for the issuance of identification
88 documentation for foster care youth.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 191, Health and Safety
1111 Code, is amended by adding Section 191.0049 to read as follows:
1212 Sec. 191.0049. BIRTH RECORD ISSUED TO FOSTER CHILD; PILOT
1313 PROGRAM. (a) In this section, "foster child" means a person who is
1414 16 years of age or older and in the managing conservatorship of the
1515 Department of Family and Protective Services.
1616 (b) On request of a foster child, the state registrar, a
1717 local registrar, or a county clerk shall issue, without a fee, a
1818 certified copy of the foster child's birth record.
1919 (c) The department shall participate in a foster child
2020 identification verification pilot program for the purpose of
2121 issuing birth records to foster children.
2222 (d) Under the pilot program, the department may:
2323 (1) enter into a memorandum of understanding with the
2424 Department of Family and Protective Services to establish an
2525 identification verification process for foster children; and
2626 (2) issue a birth certificate to a foster child whose
2727 identity has been confirmed through the verification process.
2828 (e) At the conclusion of the pilot program, the
2929 participating agencies may agree to continue the pilot program on a
3030 permanent basis.
3131 (f) Not later than January 1, 2019, the department and the
3232 Department of Family and Protective Services shall jointly issue a
3333 report to the legislature addressing the status and effectiveness
3434 of the pilot program. This subsection expires September 1, 2019.
3535 SECTION 2. Subchapter E, Chapter 521, Transportation Code,
3636 is amended by adding Section 521.1015 to read as follows:
3737 Sec. 521.1015. PERSONAL IDENTIFICATION CERTIFICATE ISSUED
3838 TO FOSTER CHILD. (a) In this section, "foster child" means a
3939 person who is 16 years of age or older and in the managing
4040 conservatorship of the Department of Family and Protective
4141 Services.
4242 (b) Notwithstanding Section 521.101, Section 521.1426, or
4343 any other provision of this chapter, a foster child may, in applying
4444 for a personal identification certificate:
4545 (1) provide a copy of the foster child's birth
4646 certificate or a copy of the foster child's social security card as
4747 proof of the foster child's identity and United States citizenship,
4848 as applicable; and
4949 (2) use the address of the regional office where the
5050 Department of Family and Protective Services caseworker for the
5151 foster child is based, if the foster child:
5252 (A) does not have a residence or domicile; or
5353 (B) cannot show proof of the foster child's
5454 residence or domicile.
5555 (c) A foster child may apply for and the department may
5656 issue a personal identification certificate without the signature
5757 or presence of or permission from a parent or guardian of the foster
5858 child.
5959 (d) A foster child is exempt from the payment of any fee for
6060 the issuance of a personal identification certificate under this
6161 chapter.
6262 SECTION 3. The changes in law made by this Act apply only to
6363 a request for a birth record or an application for a personal
6464 identification certificate submitted on or after the effective date
6565 of this Act. A request for a birth record or an application for a
6666 personal identification certificate submitted before the effective
6767 date of this Act is governed by the law as it existed immediately
6868 before the effective date of this Act, and that law is continued in
6969 effect for that purpose.
7070 SECTION 4. This Act takes effect September 1, 2017.
