| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 132.024(a)(2), Education Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | (2) "Student information" means identifying | |
| 13 | 13 | information [in the commission's possession] regarding a student | |
| 14 | 14 | that is in the possession of the commission, a career school or | |
| 15 | 15 | college, or any other school, educational institution, or business | |
| 16 | 16 | entity from which the commission receives, or regarding which the | |
| 17 | 17 | commission reviews, information through its administration or | |
| 18 | 18 | enforcement of this chapter. The term includes: | |
| 19 | 19 | (A) a student's name, address, telephone number, | |
| 20 | 20 | social security number, e-mail address, or date of birth; | |
| 21 | 21 | (B) any other identifying number or other | |
| 22 | 22 | information that foreseeably could be combined with other publicly | |
| 23 | 23 | available information to reveal identifying information regarding | |
| 24 | 24 | the student; and | |
| 25 | 25 | (C) a student's education records, as defined by | |
| 26 | 26 | 34 C.F.R. Section 99.3. | |
| 27 | 27 | SECTION 2. This Act takes effect September 1, 2017. |
