55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a plan to increase the use of telemedicine medical
88 services and telehealth services in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 1001, Health and Safety Code, is amended
1111 by adding Subchapter J to read as follows:
1212 SUBCHAPTER J. PLAN TO EXPAND TELEMEDICINE MEDICAL SERVICES AND
1313 TELEHEALTH SERVICES
1414 Sec. 1001.251. ACTION PLAN. (a) The department, with the
1515 assistance of the Texas Hospital Association, the Texas Medical
1616 Association, teaching hospitals, and the statewide health
1717 coordinating council, shall develop and implement an action plan
1818 to:
1919 (1) expand the use of telemedicine medical services,
2020 telehealth services, and related mobile applications for those
2121 services to increase access by residents of this state to health
2222 care providers; and
2323 (2) increase the availability of critical medical care
2424 and health care services to residents in this state in areas
2525 determined by the department to be medically underserved, including
2626 the border region and rural areas.
2727 (b) The department shall consult with health care
2828 providers, advocacy groups, relevant federal agencies, and any
2929 other interested persons the department considers necessary to
3030 develop the action plan required by this section.
3131 Sec. 1001.252. PLAN REQUIREMENTS. (a) The action plan
3232 developed under Section 1001.251 must include:
3333 (1) short-term and long-term plan recommendations,
3434 including policy initiatives and reforms necessary to implement the
3535 plan;
3636 (2) statutory and administrative changes necessary to
3737 implement the plan; and
3838 (3) options for the funding necessary to implement the
3939 plan.
4040 (b) The department shall:
4141 (1) not later than September 1, 2019:
4242 (A) submit to the governor and the legislature
4343 the recommendations, the statutory and administrative changes, and
4444 the funding options described in Subsection (a) and short-term and
4545 long-term plans to implement those recommendations, changes, and
4646 options; and
4747 (B) begin implementing the short-term plan;
4848 (2) not later than September 1, 2021, fully implement
4949 the short-term plan;
5050 (3) not later than September 1, 2027, fully implement
5151 the long-term plan; and
5252 (4) include the short-term and long-term plans in the
5353 material the department prepares for consideration of the
5454 commission in connection with the update of the strategic plan for
5555 health and human services under Section 531.022, Government Code.
5656 Sec. 1001.253. EXPIRATION. This subchapter expires
5757 September 1, 2027.
5858 SECTION 2. This Act takes effect immediately if it receives
5959 a vote of two-thirds of all the members elected to each house, as
6060 provided by Section 39, Article III, Texas Constitution. If this
6161 Act does not receive the vote necessary for immediate effect, this
6262 Act takes effect September 1, 2017.
