77 relating to the establishment of a pilot program for the issuance of
88 digital driver's licenses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle B, Title 7, Transportation Code, is
1111 amended by adding Chapter 526 to read as follows:
1212 CHAPTER 526. DIGITAL DRIVER'S LICENSE PILOT PROGRAM
1313 Sec. 526.001. DEFINITIONS. In this chapter, "department"
1414 and "driver's license" have the meanings assigned by Section
1515 521.001.
1616 Sec. 526.002. DIGITAL DRIVER'S LICENSE PILOT PROGRAM. (a)
1717 If funds are appropriated for the purposes of this chapter, the
1818 department by rule may establish a pilot program for the issuance of
1919 digital driver's licenses in Cameron County.
2020 (b) In establishing the digital driver's license pilot
2121 program, the department shall incorporate one or more of the
2222 following phases:
2323 (1) an assessment of existing department
2424 infrastructure and an identification of changes required to
2525 implement the program;
2626 (2) an upgrade to department infrastructure according
2727 to the department's findings under Subdivision (1);
2828 (3) creation of a mobile application that:
2929 (A) displays a digital driver's license on a
3030 wireless communication device; and
3131 (B) includes an authentication and verification
3232 process for a wireless communication device;
3333 (4) deployment of the digital driver's license mobile
3434 application to department users for testing and evaluation; and
3535 (5) on department approval, the expansion of the
3636 deployment of the digital driver's license mobile application to a
3737 small volunteer group consisting of members of the public and the
3838 implementation of a law enforcement version of the application for
3939 field testing.
4040 (c) The department may contract with another person to
4141 establish the pilot program described by this section.
4242 (d) The department shall prepare a report containing the
4343 results of the pilot program and the department's recommendations.
4444 The department shall submit the report to the Public Safety
4545 Commission and the legislature not later than December 1, 2018.
4646 Sec. 526.003. EXPIRATION. This chapter expires September
4747 1, 2019.
4848 SECTION 2. This Act takes effect immediately if it receives
4949 a vote of two-thirds of all the members elected to each house, as
5050 provided by Section 39, Article III, Texas Constitution. If this
5151 Act does not receive the vote necessary for immediate effect, this
5252 Act takes effect September 1, 2017.
