| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle B, Title 7, Transportation Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 526 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 526. DIGITAL DRIVER'S LICENSE PILOT PROGRAM |
|---|
| 13 | 13 | | Sec. 526.001. DEFINITIONS. In this chapter, "department" |
|---|
| 14 | 14 | | and "driver's license" have the meanings assigned by Section |
|---|
| 15 | 15 | | 521.001. |
|---|
| 16 | 16 | | Sec. 526.002. DIGITAL DRIVER'S LICENSE PILOT PROGRAM. (a) |
|---|
| 17 | 17 | | If funds are appropriated for the purposes of this chapter, the |
|---|
| 18 | 18 | | department by rule may establish a pilot program for the issuance of |
|---|
| 19 | 19 | | digital driver's licenses in Cameron County. |
|---|
| 20 | 20 | | (b) In establishing the digital driver's license pilot |
|---|
| 21 | 21 | | program, the department shall incorporate one or more of the |
|---|
| 22 | 22 | | following phases: |
|---|
| 23 | 23 | | (1) an assessment of existing department |
|---|
| 24 | 24 | | infrastructure and an identification of changes required to |
|---|
| 25 | 25 | | implement the program; |
|---|
| 26 | 26 | | (2) an upgrade to department infrastructure according |
|---|
| 27 | 27 | | to the department's findings under Subdivision (1); |
|---|
| 28 | 28 | | (3) creation of a mobile application that: |
|---|
| 29 | 29 | | (A) displays a digital driver's license on a |
|---|
| 30 | 30 | | wireless communication device; and |
|---|
| 31 | 31 | | (B) includes an authentication and verification |
|---|
| 32 | 32 | | process for a wireless communication device; |
|---|
| 33 | 33 | | (4) deployment of the digital driver's license mobile |
|---|
| 34 | 34 | | application to department users for testing and evaluation; and |
|---|
| 35 | 35 | | (5) on department approval, the expansion of the |
|---|
| 36 | 36 | | deployment of the digital driver's license mobile application to a |
|---|
| 37 | 37 | | small volunteer group consisting of members of the public and the |
|---|
| 38 | 38 | | implementation of a law enforcement version of the application for |
|---|
| 39 | 39 | | field testing. |
|---|
| 40 | 40 | | (c) The department may contract with another person to |
|---|
| 41 | 41 | | establish the pilot program described by this section. |
|---|
| 42 | 42 | | (d) The department shall prepare a report containing the |
|---|
| 43 | 43 | | results of the pilot program and the department's recommendations. |
|---|
| 44 | 44 | | The department shall submit the report to the Public Safety |
|---|
| 45 | 45 | | Commission and the legislature not later than December 1, 2018. |
|---|
| 46 | 46 | | Sec. 526.003. EXPIRATION. This chapter expires September |
|---|
| 47 | 47 | | 1, 2019. |
|---|
| 48 | 48 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2017. |
