44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the sale of certain state property in Brazoria County by
77 the Texas Board of Criminal Justice.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. (a) Not later than June 30, 2018, the Texas
1010 Board of Criminal Justice shall sell the real property described by
1111 Subsection (d) of this section if the board receives a bid of at
1212 least $740,000 for the property.
1313 (b) The Texas Board of Criminal Justice shall sell the
1414 property as provided by Section 496.0021, Government Code. The
1515 General Land Office shall negotiate and close a transaction
1616 involving the real property described by this section on behalf of
1717 the board using the procedures under Section 31.158, Natural
1818 Resources Code. The sale shall exclude the mineral interests in and
1919 under the property, and the deed shall contain a provision
2020 expressly reserving the state's interest in and right to remove all
2121 oil, gas, and other minerals in and under the real property
2222 described by Subsection (d) of this section.
2323 (c) In this section, "proposed reservoir tract" means the
2424 2,200 acres sold in Brazoria County by the Texas Board of Criminal
2525 Justice in 2011.
2626 (d) The Texas Board of Criminal Justice shall sell the
2727 property described as follows:
2828 Approximately 22 acres, more or less, along the un-named
2929 tributary to Oyster Creek within the 2,682 acre tract or parcel of
3030 land conveyed to the Prison Commission of the State of Texas as
3131 recorded in Book 145, Page 307 of the Deed Records Brazoria County,
3232 Texas lying within the Stephen F. Austin League No 8, Abstract 25 in
3333 Brazoria County, Texas near the City of Angleton, Texas. The
3434 approximate boundaries of the 22 acres are: starting at the
3535 confluence of the un-named tributary to Oyster Creek and the Oyster
3636 Creek channel which is located approximately 673 feet north of the
3737 proposed reservoir tract, extending north approximately 3,660 feet
3838 along the un-named tributary to Oyster Creek and extending east and
3939 west of the centerline of said tributary approximately 130 feet;
4040 And, approximately 274 acres along Oyster Creek, more or
4141 less, being part of the 2,682 acre tract or parcel of land conveyed
4242 to the Prison Commission of the State of Texas as recorded in Book
4343 145, Page 307 of the Deed Records of Brazoria County, Texas lying
4444 within the Stephen F. Austin League No. 8, Abstract 25; and the
4545 Stephen Richardson League, abstract 122; and the William Harris
4646 League, abstract 71 in Brazoria County, Texas near the City of
4747 Angleton, Texas. The approximate boundaries of the 274 acres are:
4848 from the confluence of the un-named tributary to Oyster Creek and
4949 Oyster Creek channel, located approximately 673 feet north of the
5050 northeast corner of the proposed reservoir tract to the northeast
5151 corner of the proposed reservoir tract and extending east and west
5252 of the centerline of the Oyster Creek Channel approximately 220
5353 feet; from the northeast corner of the proposed reservoir tract to
5454 the intersection of the center line of Oyster Creek with the eastern
5555 boundary of the old railroad grade road, lands that extend from
5656 approximately 220 feet east of the center line of Oyster Creek,
5757 westward and southward to the proposed reservoir tract; land
5858 extending south and westward from the intersection of centerline of
5959 Oyster Creek and the eastern boundary of the old railroad Grade
6060 road, south through points defined by latitude and longitude
6161 coordinates:
6262 Latitude: 29.260925°, Longitude: -95.527633°;
6363 Latitude: 29.260682°, Longitude: -95.526219°;
6464 Latitude: 29.259672°, Longitude: -95.525333°;
6565 Latitude: 29.259409°, Longitude: -95.523467°;
6666 Latitude: 29.259481°, Longitude: -95.521911°;
6767 Latitude: 29.259356°, Longitude: -95.521045°; and
6868 Latitude: 29.258961°, Longitude: -95.520931° with the
6969 southern boundary being formed by the southern limits of
7070 continguous land conveyed to the Prison Commission of the State of
7171 Texas.
7272 SECTION 2. This Act takes effect immediately if it receives
7373 a vote of two-thirds of all the members elected to each house, as
7474 provided by Section 39, Article III, Texas Constitution. If this
7575 Act does not receive the vote necessary for immediate effect, this
7676 Act takes effect September 1, 2017.
