5	5	AN ACT
6	6	relating to the sale of certain state property in Brazoria County by
7	7	the Texas Board of Criminal Justice.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. (a) Not later than June 30, 2018, the Texas
10	10	Board of Criminal Justice shall sell the real property described by
11	11	Subsection (d) of this section if the board receives a bid of at
12	12	least $740,000 for the property.
13	13	(b) The Texas Board of Criminal Justice shall sell the
14	14	property as provided by Section 496.0021, Government Code. The
15	15	General Land Office shall negotiate and close a transaction
16	16	involving the real property described by this section on behalf of
17	17	the board using the procedures under Section 31.158, Natural
18	18	Resources Code. The sale shall exclude the mineral interests in and
19	19	under the property, and the deed shall contain a provision
20	20	expressly reserving the state's interest in and right to remove all
21	21	oil, gas, and other minerals in and under the real property
22	22	described by Subsection (d) of this section.
23	23	(c) In this section, "proposed reservoir tract" means the
24	24	2,200 acres sold in Brazoria County by the Texas Board of Criminal
25	25	Justice in 2011.
26	26	(d) The Texas Board of Criminal Justice shall sell the
27	27	property described as follows:
28	28	Approximately 22 acres, more or less, along the un-named
29	29	tributary to Oyster Creek within the 2,682 acre tract or parcel of
30	30	land conveyed to the Prison Commission of the State of Texas as
31	31	recorded in Book 145, Page 307 of the Deed Records Brazoria County,
32	32	Texas lying within the Stephen F. Austin League No 8, Abstract 25 in
33	33	Brazoria County, Texas near the City of Angleton, Texas. The
34	34	approximate boundaries of the 22 acres are: starting at the
35	35	confluence of the un-named tributary to Oyster Creek and the Oyster
36	36	Creek channel which is located approximately 673 feet north of the
37	37	proposed reservoir tract, extending north approximately 3,660 feet
38	38	along the un-named tributary to Oyster Creek and extending east and
39	39	west of the centerline of said tributary approximately 130 feet;
40	40	And, approximately 274 acres along Oyster Creek, more or
41	41	less, being part of the 2,682 acre tract or parcel of land conveyed
42	42	to the Prison Commission of the State of Texas as recorded in Book
43	43	145, Page 307 of the Deed Records of Brazoria County, Texas lying
44	44	within the Stephen F. Austin League No. 8, Abstract 25; and the
45	45	Stephen Richardson League, abstract 122; and the William Harris
46	46	League, abstract 71 in Brazoria County, Texas near the City of
47	47	Angleton, Texas. The approximate boundaries of the 274 acres are:
48	48	from the confluence of the un-named tributary to Oyster Creek and
49	49	Oyster Creek channel, located approximately 673 feet north of the
50	50	northeast corner of the proposed reservoir tract to the northeast
51	51	corner of the proposed reservoir tract and extending east and west
52	52	of the centerline of the Oyster Creek Channel approximately 220
53	53	feet; from the northeast corner of the proposed reservoir tract to
54	54	the intersection of the center line of Oyster Creek with the eastern
55	55	boundary of the old railroad grade road, lands that extend from
56	56	approximately 220 feet east of the center line of Oyster Creek,
57	57	westward and southward to the proposed reservoir tract; land
58	58	extending south and westward from the intersection of centerline of
59	59	Oyster Creek and the eastern boundary of the old railroad Grade
60	60	road, south through points defined by latitude and longitude
61	61	coordinates:
62	62	Latitude: 29.260925°, Longitude: -95.527633°;
63	63	Latitude: 29.260682°, Longitude: -95.526219°;
64	64	Latitude: 29.259672°, Longitude: -95.525333°;
65	65	Latitude: 29.259409°, Longitude: -95.523467°;
66	66	Latitude: 29.259481°, Longitude: -95.521911°;
67	67	Latitude: 29.259356°, Longitude: -95.521045°; and
68	68	Latitude: 29.258961°, Longitude: -95.520931° with the
69	69	southern boundary being formed by the southern limits of
70	70	continguous land conveyed to the Prison Commission of the State of
71	71	Texas.
72	72	SECTION 2. This Act takes effect immediately if it receives
73	73	a vote of two-thirds of all the members elected to each house, as
74	74	provided by Section 39, Article III, Texas Constitution. If this
75	75	Act does not receive the vote necessary for immediate effect, this
76	76	Act takes effect September 1, 2017.
