66 relating to determination of resident status.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 54.052, Education Code, is amended to
99 read as follows:
1010 DETERMINATION OF RESIDENT STATUS. (a) Subject to the other
1111 applicable provisions of this subchapter governing the
1212 determination of resident status, the following persons are
1313 considered residents of this state for purposes of this title:
1414 (1) a person who:
1515 (A) established a domicile in this state not
1616 later than one year before the census date of the academic term in
1717 which the person is enrolled in an institution of higher education;
1818 and
1919 (B) maintained that domicile continuously for
2020 the year preceding that census date;
2121 (2) a dependent whose parent:
2222 (A) established a domicile in this state not
2323 later than one year before the census date of the academic term in
2424 which the dependent is enrolled in an institution of higher
2525 education; and
2626 (B) maintained that domicile continuously for
2727 the year preceding that census date. ; and
2828 (3) a person who:
2929 (A) graduated from a public or private high
3030 school in this state or received the equivalent of a high school
3131 diploma in this state; and
3232 (B) maintained a residence continuously in this
3333 state for:
3434 (i) the three years preceding the date of
3535 graduation or receipt of the diploma equivalent, as applicable; and
3636 (ii) the year preceding the census date of
3737 the academic term in which the person is enrolled in an institution
3838 of higher education.
3939 (b) For purposes of this section, the domicile of a
4040 dependent's parent is presumed to be the domicile of the dependent.
4141 unless the person establishes eligibility for resident status under
4242 Subsection (a)(3).
4343 SECTION 2. This Act takes effect September 1, 2017.
