| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 54.052, Education Code, is amended to |
|---|
| 9 | 9 | | read as follows: |
|---|
| 10 | 10 | | DETERMINATION OF RESIDENT STATUS. (a) Subject to the other |
|---|
| 11 | 11 | | applicable provisions of this subchapter governing the |
|---|
| 12 | 12 | | determination of resident status, the following persons are |
|---|
| 13 | 13 | | considered residents of this state for purposes of this title: |
|---|
| 14 | 14 | | (1) a person who: |
|---|
| 15 | 15 | | (A) established a domicile in this state not |
|---|
| 16 | 16 | | later than one year before the census date of the academic term in |
|---|
| 17 | 17 | | which the person is enrolled in an institution of higher education; |
|---|
| 18 | 18 | | and |
|---|
| 19 | 19 | | (B) maintained that domicile continuously for |
|---|
| 20 | 20 | | the year preceding that census date; |
|---|
| 21 | 21 | | (2) a dependent whose parent: |
|---|
| 22 | 22 | | (A) established a domicile in this state not |
|---|
| 23 | 23 | | later than one year before the census date of the academic term in |
|---|
| 24 | 24 | | which the dependent is enrolled in an institution of higher |
|---|
| 25 | 25 | | education; and |
|---|
| 26 | 26 | | (B) maintained that domicile continuously for |
|---|
| 27 | 27 | | the year preceding that census date. ; and |
|---|
| 28 | 28 | | (3) a person who: |
|---|
| 29 | 29 | | (A) graduated from a public or private high |
|---|
| 30 | 30 | | school in this state or received the equivalent of a high school |
|---|
| 31 | 31 | | diploma in this state; and |
|---|
| 32 | 32 | | (B) maintained a residence continuously in this |
|---|
| 33 | 33 | | state for: |
|---|
| 34 | 34 | | (i) the three years preceding the date of |
|---|
| 35 | 35 | | graduation or receipt of the diploma equivalent, as applicable; and |
|---|
| 36 | 36 | | (ii) the year preceding the census date of |
|---|
| 37 | 37 | | the academic term in which the person is enrolled in an institution |
|---|
| 38 | 38 | | of higher education. |
|---|
| 39 | 39 | | (b) For purposes of this section, the domicile of a |
|---|
| 40 | 40 | | dependent's parent is presumed to be the domicile of the dependent. |
|---|
| 41 | 41 | | unless the person establishes eligibility for resident status under |
|---|
| 42 | 42 | | Subsection (a)(3). |

| 43 | 43 | | SECTION 2. This Act takes effect September 1, 2017. |
