5+ A BILL TO BE ENTITLED
46 AN ACT
57 relating to the appointment of a bailiff by district courts and
68 county courts at law in Bowie County.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 53.001, Government Code, is amended by
911 adding Subsection (k) to read as follows:
1012 (k) The judges of the 5th, 102nd, and 202nd district courts
1113 and the judges of the county courts at law of Bowie County shall
1214 appoint one or more bailiffs to serve the courts in Bowie County.
1315 SECTION 2. Section 53.007(a), Government Code, is amended
1416 to read as follows:
1517 (a) This section applies to:
1618 (1) the 34th, 70th, 71st, 86th, 97th, 130th, 142nd,
1719 161st, 238th, 318th, 341st, 355th, and 385th district courts;
1820 (2) the County Court of Harrison County;
1921 (3) the criminal district courts of Tarrant County;
2022 (4) the district courts in Taylor County;
2123 (5) the courts described in Section 53.002(c), (d),
2224 (e), or (f);
2325 (6) the county courts at law of Taylor County;
2426 (7) the district courts in Tarrant County that give
2527 preference to criminal cases; [and]
2628 (8) the 115th District Court in Upshur County; and
2729 (9) the 5th, 102nd, and 202nd district courts and the
2830 county courts at law of Bowie County.
2931 SECTION 3. Section 53.0071, Government Code, is amended to
3032 read as follows:
3133 Sec. 53.0071. BAILIFF AS PEACE OFFICER. Unless the
3234 appointing judge provides otherwise in the order of appointment, a
3335 bailiff appointed under Section 53.001(b), [or] (g), or (k) or
3436 53.002(c), (e), or (f) is a "peace officer" for purposes of Article
3537 2.12, Code of Criminal Procedure.
3638 SECTION 4. This Act takes effect September 1, 2017.
