| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 53.001, Government Code, is amended by |
|---|
| 9 | 11 | | adding Subsection (k) to read as follows: |
|---|
| 10 | 12 | | (k) The judges of the 5th, 102nd, and 202nd district courts |
|---|
| 11 | 13 | | and the judges of the county courts at law of Bowie County shall |
|---|
| 12 | 14 | | appoint one or more bailiffs to serve the courts in Bowie County. |
|---|
| 13 | 15 | | SECTION 2. Section 53.007(a), Government Code, is amended |
|---|
| 14 | 16 | | to read as follows: |
|---|
| 15 | 17 | | (a) This section applies to: |
|---|
| 16 | 18 | | (1) the 34th, 70th, 71st, 86th, 97th, 130th, 142nd, |
|---|
| 17 | 19 | | 161st, 238th, 318th, 341st, 355th, and 385th district courts; |
|---|
| 18 | 20 | | (2) the County Court of Harrison County; |
|---|
| 19 | 21 | | (3) the criminal district courts of Tarrant County; |
|---|
| 20 | 22 | | (4) the district courts in Taylor County; |
|---|
| 21 | 23 | | (5) the courts described in Section 53.002(c), (d), |
|---|
| 22 | 24 | | (e), or (f); |
|---|
| 23 | 25 | | (6) the county courts at law of Taylor County; |
|---|
| 24 | 26 | | (7) the district courts in Tarrant County that give |
|---|
| 25 | 27 | | preference to criminal cases; [and] |
|---|
| 26 | 28 | | (8) the 115th District Court in Upshur County; and |
|---|
| 27 | 29 | | (9) the 5th, 102nd, and 202nd district courts and the |
|---|
| 28 | 30 | | county courts at law of Bowie County. |

| 29 | 31 | | SECTION 3. Section 53.0071, Government Code, is amended to |
|---|
| 30 | 32 | | read as follows: |
|---|
| 31 | 33 | | Sec. 53.0071. BAILIFF AS PEACE OFFICER. Unless the |
|---|
| 32 | 34 | | appointing judge provides otherwise in the order of appointment, a |
|---|
| 33 | 35 | | bailiff appointed under Section 53.001(b), [or] (g), or (k) or |
|---|
| 34 | 36 | | 53.002(c), (e), or (f) is a "peace officer" for purposes of Article |
|---|
| 35 | 37 | | 2.12, Code of Criminal Procedure. |

| 36 | 38 | | SECTION 4. This Act takes effect September 1, 2017. |
