12	6		AN ACT
13	7		relating to the placement of certain substances in Penalty Groups 1
14	8		and 3 of the Texas Controlled Substances Act for the purposes of
15	9		prosecution of criminal offenses involving those substances.
16	10		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
17	11		SECTION 1. Section 481.102, Health and Safety Code, is
18	12		amended to read as follows:

201	195		contains any quantity of the following substances having a
202	196		potential for abuse associated with a stimulant effect on the
203	197		central nervous system:

205	199		Phenmetrazine and its salts;
206	200		(2) a material, compound, mixture, or preparation that
207	201		contains any quantity of the following substances having a
208	202		potential for abuse associated with a depressant effect on the
209	203		central nervous system:
210	204		a substance that contains any quantity of a
211	205		derivative of barbituric acid, or any salt of a derivative of
212	206		barbituric acid not otherwise described by this subsection;
213	207		a compound, mixture, or preparation containing
214	208		amobarbital, secobarbital, pentobarbital, or any salt of any of
215	209		these, and one or more active medicinal ingredients that are not
216	210		listed in any penalty group;
217	211		a suppository dosage form containing amobarbital,
218	212		secobarbital, pentobarbital, or any salt of any of these drugs, and
219	213		approved by the United States Food and Drug Administration for

436	431		SECTION 3. The change in law made by this Act applies only
437	432		to an offense committed on or after the effective date of this Act.
438	433		An offense committed before the effective date of this Act is
439	434		governed by the law in effect on the date the offense was committed,
440	435		and the former law is continued in effect for that purpose. For
441	436		purposes of this section, an offense was committed before the
442	437		effective date of this Act if any element of the offense occurred
443	438		before that date.
444	439		SECTION 4. This Act takes effect September 1, 2017.
