66 AN ACT
77 relating to the creation of an innocence project grant program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 79.039(a), Government Code, is amended
1010 to read as follows:
1111 (a) Each legal clinic or program in this state [that is
1212 operated by a law school and] that receives financial support from
1313 the commission shall submit to the commission an annual report
1414 regarding criminal cases:
1515 (1) in which the clinic or program has provided legal
1616 services to an indigent defendant during the preceding calendar
1717 year; and
1818 (2) in which:
1919 (A) based on a finding of actual innocence, the
2020 court of criminal appeals overturns a conviction; or
2121 (B) the governor issues a pardon based on actual
2222 innocence.
2323 SECTION 2. Subchapter C, Chapter 79, Government Code, is
2424 amended by adding Section 79.041 to read as follows:
2525 Sec. 79.041. INNOCENCE PROJECT GRANT PROGRAM. (a) Using
2626 any funds available for the purpose, the commission may establish
2727 an innocence project grant program to support:
2828 (1) projects that screen, investigate, and litigate
2929 post-conviction claims of actual innocence in non-capital cases in
3030 this state; and
3131 (2) associated expenses necessary to conduct those
3232 activities.
3333 (b) In making grant awards under the program, the commission
3434 shall promote among projects coordinated strategies that will
3535 enable those projects to efficiently screen requests for assistance
3636 and to engage in effective investigation and litigation activities.
3737 (c) Only the following entities are eligible to receive
3838 grants under the program:
3939 (1) a public or private law school in Texas; or
4040 (2) a nonprofit organization based in this state that
4141 operates an innocence project.
4242 (d) The commission may adopt rules to implement this
4343 section.
4444 SECTION 3. This Act takes effect September 1, 2017.
