65 AN ACT
76 relating to the average daily attendance calculation for students
87 over 18 years of age who are in an off home campus instructional
98 arrangement.
109 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1110 SECTION 1. Section 42.151, Education Code, is amended by
1211 adding Subsection (f-1) to read as follows:
1312 (f-1) Notwithstanding Subsection (f), a student who is 18
1413 years of age or older who has met graduation credit requirements and
1514 is in an off home campus instructional arrangement is a full-time
1615 equivalent student if the student receives 20 hours of contact a
1716 week. A student described by this subsection is a part-time
1817 equivalent student if the student receives 10 hours or more but less
1918 than 20 hours of contact a week. The commissioner may adopt rules
2019 necessary to administer this section.
2120 SECTION 2. The commissioner of education may adopt rules to
2221 administer this Act.
2322 SECTION 3. The commissioner of education is required to
2423 implement this Act only if the legislature appropriates money
2524 specifically for that purpose. If the legislature does not
2625 appropriate money specifically for that purpose, the commissioner
2726 of education may, but is not required to, implement this Act using
2827 other appropriations available for the purpose.
2928 SECTION 4. This Act applies beginning with the 2017-2018
3029 school year.
