10 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 10 | | SECTION 1. Section 42.151, Education Code, is amended by |
---|
12 | 11 | | adding Subsection (f-1) to read as follows: |

13 | 12 | | (f-1) Notwithstanding Subsection (f), a student who is 18 |
---|
14 | 13 | | years of age or older who has met graduation credit requirements and |
---|
15 | 14 | | is in an off home campus instructional arrangement is a full-time |
---|
16 | 15 | | equivalent student if the student receives 20 hours of contact a |
---|
17 | 16 | | week. A student described by this subsection is a part-time |
---|
18 | 17 | | equivalent student if the student receives 10 hours or more but less |
---|
19 | 18 | | than 20 hours of contact a week. The commissioner may adopt rules |
---|
20 | 19 | | necessary to administer this section. |

21 | 20 | | SECTION 2. The commissioner of education may adopt rules to |
---|
22 | 21 | | administer this Act. |
---|
23 | 22 | | SECTION 3. The commissioner of education is required to |
---|
24 | 23 | | implement this Act only if the legislature appropriates money |
---|
25 | 24 | | specifically for that purpose. If the legislature does not |
---|
26 | 25 | | appropriate money specifically for that purpose, the commissioner |
---|
27 | 26 | | of education may, but is not required to, implement this Act using |
---|
28 | 27 | | other appropriations available for the purpose. |
---|
29 | 28 | | SECTION 4. This Act applies beginning with the 2017-2018 |
---|
30 | 29 | | school year. |
