55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the powers and duties of a county or municipality to
88 impose taxes on behalf of a navigation district.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 62.160, Water Code, is amended to read as
1111 follows:
1212 Sec. 62.160. MAINTENANCE TAX. (a) The commissioners
1313 courts of the respective counties inside each district may, and on
1414 request by the district, shall, levy and have assessed and
1515 collected for the maintenance, operation, and upkeep of the
1616 district and the improvements constructed by the district an annual
1717 tax not to exceed 10 cents on the $100 valuation on all property
1818 inside the district.
1919 (b) The governing bodies of the respective municipalities
2020 inside each district may, and on request of the district, shall,
2121 levy and have assessed and collected for the maintenance,
2222 operation, and upkeep of the district and the improvements
2323 constructed by the district an annual tax not to exceed 10 cents on
2424 the $100 valuation on all property inside the district.
2525 (c) The district on behalf of which a tax is collected under
2626 Subsections (a) and (b) shall pay the costs of levying, assessing,
2727 and collecting the tax.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2017.
