| 7 | 7 | | relating to the powers and duties of a county or municipality to |

| 8 | 8 | | impose taxes on behalf of a navigation district. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 62.160, Water Code, is amended to read as |
|---|
| 11 | 11 | | follows: |
|---|
| 12 | 12 | | Sec. 62.160. MAINTENANCE TAX. (a) The commissioners |
|---|
| 13 | 13 | | courts of the respective counties inside each district may, and on |
|---|
| 14 | 14 | | request by the district, shall, levy and have assessed and |
|---|
| 15 | 15 | | collected for the maintenance, operation, and upkeep of the |
|---|
| 16 | 16 | | district and the improvements constructed by the district an annual |
|---|
| 17 | 17 | | tax not to exceed 10 cents on the $100 valuation on all property |
|---|
| 18 | 18 | | inside the district. |
|---|
| 19 | 19 | | (b) The governing bodies of the respective municipalities |
|---|
| 20 | 20 | | inside each district may, and on request of the district, shall, |
|---|
| 21 | 21 | | levy and have assessed and collected for the maintenance, |
|---|
| 22 | 22 | | operation, and upkeep of the district and the improvements |
|---|
| 23 | 23 | | constructed by the district an annual tax not to exceed 10 cents on |
|---|
| 24 | 24 | | the $100 valuation on all property inside the district. |
|---|
| 25 | 25 | | (c) The district on behalf of which a tax is collected under |
|---|
| 26 | 26 | | Subsections (a) and (b) shall pay the costs of levying, assessing, |
|---|
| 27 | 27 | | and collecting the tax. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 29 | 29 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 30 | 30 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 31 | 31 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 32 | 32 | | Act takes effect September 1, 2017. |
