44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to state fiscal matters related to health and human
77 services and state agencies administering health and human services
88 programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1.01. This article applies to any state agency that
1111 receives an appropriation under Article II of the General
1212 Appropriations Act and to any program administered by any of those
1313 agencies.
1414 SECTION 1.02. Notwithstanding any other statute of this
1515 state, each state agency to which this article applies is
1616 authorized to reduce or recover expenditures by:
1717 (1) consolidating any reports or publications the
1818 agency is required to make and filing or delivering any of those
1919 reports or publications exclusively by electronic means;
2020 (2) extending the effective period of any license,
2121 permit, or registration the agency grants or administers;
2222 (3) entering into a contract with another governmental
2323 entity or with a private vendor to carry out any of the agency's
2424 duties;
2525 (4) adopting additional eligibility requirements
2626 consistent with federal law for persons who receive benefits under
2727 any law the agency administers to ensure that those benefits are
2828 received by the most deserving persons consistent with the purposes
2929 for which the benefits are provided, including under the following
3030 laws:
3131 (A) Chapter 62, Health and Safety Code (child
3232 health plan program);
3333 (B) Chapter 31, Human Resources Code (temporary
3434 assistance for needy families program);
3535 (C) Chapter 32, Human Resources Code (Medicaid
3636 program);
3737 (D) Chapter 33, Human Resources Code
3838 (supplemental nutrition assistance and other nutritional
3939 assistance programs); and
4040 (E) Chapter 533, Government Code (Medicaid
4141 managed care);
4242 (5) providing that any communication between the
4343 agency and another person and any document required to be delivered
4444 to or by the agency, including any application, notice, billing
4545 statement, receipt, or certificate, may be made or delivered by
4646 e-mail or through the Internet;
4747 (6) adopting and collecting fees or charges to cover
4848 any costs the agency incurs in performing its lawful functions; and
4949 (7) modifying and streamlining processes used in:
5050 (A) the conduct of eligibility determinations
5151 for programs listed in Subdivision (4) of this subsection by or
5252 under the direction of the Health and Human Services Commission;
5353 (B) the provision of child and adult protective
5454 services by the Department of Family and Protective Services;
5555 (C) the provision of services for the aging and
5656 disabled by the Health and Human Services Commission;
5757 (D) the provision of services to children and
5858 other persons with disabilities by the Health and Human Services
5959 Commission; and
6060 (E) the provision or administration of other
6161 services provided or programs operated by the Health and Human
6262 Services Commission or a health and human services agency, as
6363 defined by Section 531.001, Government Code.
6464 ARTICLE 2. HEALTH AND HUMAN SERVICES EMPLOYEES
6565 SECTION 2.01. An health and human services employee is not
6666 entitled to an amount from the state for expenses, per diem, travel,
6767 or salary that exceeds the amount authorized for those purposes by
6868 the General Appropriations Act.
6969 SECTION 2.02. An health and human services employee is not
7070 entitled to an amount from the state for a salary, a salary
7171 supplement, office expenses or reimbursement of office expenses, or
7272 travel that exceeds the amount authorized for those purposes by the
7373 General Appropriations Act.
7474 ARTICLE 3. REDUCTION OF EXPENDITURES AND IMPOSITION OF CHARGES AND
7575 COST-SAVING MEASURES SPECIFICALLY
7676 Sec. 265.0042. COLLABORATION WITH INSTITUTIONS OF HIGHER
7777 EDUCATION. (a) Subject to the availability of funds, the Health and
7878 Human Services Commission, on behalf of the department, shall enter
7979 into agreements with institutions of higher education to conduct
8080 efficacy reviews of any prevention and early intervention programs
8181 that have not previously been evaluated for effectiveness through a
8282 scientific research evaluation process.
8383 (b) Subject to the availability of funds, the department
8484 shall collaborate with an institution of higher education to create
8585 and track indicators of child well-being to determine the
8686 effectiveness of prevention and early intervention services.
8787 SECTION 3.03. If before implementing any provision of this
8888 article a state agency determines that a waiver or authorization
8989 from a federal agency is necessary for implementation of that
9090 provision, the agency affected by the provision shall request the
9191 waiver or authorization and may delay implementing that provision
9292 until the waiver or authorization is granted.
9393 Article 4. PILOT PROGRAM PROPOSALS AND RULES
9494 SECTION 4.01. The commissioner of each state agency to
9595 which this article applies may propose to the appropriate
9696 legislative committee pilot programs that could be tested to
9797 determine if the programs might produce long term fiscal benefits
9898 to the state. The commissioner may propose rules necessary to
9999 implement the pilot programs.

101101 SECTION 5.01. This Act takes effect September 1, 2017.
