By: RodrÃguez S.B. No. 2226 A BILL TO BE ENTITLED AN ACT relating to the renewal of the Texas Health Care Transformation and Quality Improvement Program waiver under Medicaid. BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Chapter 531, Government Code, is amended by adding Subchapter N-1 to read as follows: SUBCHAPTER N-1. TEXAS HEALTH CARE TRANSFORMATION AND QUALITY IMPROVEMENT PROGRAM WAIVER Sec. 531.521. RENEWAL REQUIREMENTS. Any renewal of the Texas Health Care Transformation and Quality Improvement Program waiver issued under Section 1115 of the federal Social Security Act (42 U.S.C. Section 1315) must: (1) allocate funding to hospitals and other safety net providers to ensure the financial viability of the hospitals and providers; (2) provide incentives for: (A) developing and expanding local and regional health care systems in order to reduce health care costs and increase the amount and types of health care services provided to uninsured persons; and (B) encouraging Medicaid recipients to actively participate in their health care and engage in healthy behaviors; (3) provide a continuum of health care services for Medicaid recipients that includes: (A) preventive care; (B) primary care; (C) specialty care; (D) outpatient services; (E) inpatient services; (F) mental health services; and (G) substance use services; (4) allow for variation in the manner Medicaid services are delivered, including through the use of: (A) managed care organizations; (B) accountable care organizations; or (C) health savings accounts; and (5) ensure that any additional federal matching funds available are accepted and used to provide local and regional health care services to otherwise uninsured persons. SECTION 2. This Act takes effect immediately if it receives a vote of two-thirds of all the members elected to each house, as provided by Section 39, Article III, Texas Constitution. If this Act does not receive the vote necessary for immediate effect, this Act takes effect September 1, 2017.
