44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to prescription medications for the care and treatment of
77 inmates and prisoners in county jails.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 511, Government Code, is amended by adding
1010 Section 511.009(a)(21) to read as follows:
1111 (21) The commission shall adopt reasonable rules and
1212 procedures establishing minimum standards regarding the continuity
1313 of prescription medications for the care and treatment of inmates
1414 and prisoners in county jails. The rules and procedures shall
1515 require that inmates and prisoners who are determined to be
1616 lawfully taking a prescription medication when they enter the
1717 county jail be maintained on that same prescription medication
1818 until a qualified health care professional directs otherwise upon
1919 individualized consideration.
2020 SECTION 2. This Act takes effect September 1, 2017.
