8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Chapter 511, Government Code, is amended by adding | |
10 | 10 | Section 511.009(a)(21) to read as follows: | |
11 | 11 | (21) The commission shall adopt reasonable rules and | |
12 | 12 | procedures establishing minimum standards regarding the continuity | |
13 | 13 | of prescription medications for the care and treatment of inmates | |
14 | 14 | and prisoners in county jails. The rules and procedures shall | |
15 | 15 | require that inmates and prisoners who are determined to be | |
16 | 16 | lawfully taking a prescription medication when they enter the | |
17 | 17 | county jail be maintained on that same prescription medication | |
18 | 18 | until a qualified health care professional directs otherwise upon | |
19 | 19 | individualized consideration. | |
20 | 20 | SECTION 2. This Act takes effect September 1, 2017. |
