| 8 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 11 | | SECTION 1. Subchapter B, Chapter 8440, Special District |
|---|
| 10 | 12 | | Local Laws Code, is amended by adding Section 8440.052 to read as |
|---|
| 11 | 13 | | follows: |
|---|
| 12 | 14 | | Sec. 8440.052. ELECTION DATE. The district shall hold an |
|---|
| 13 | 15 | | election to elect the appropriate number of directors on the |
|---|
| 14 | 16 | | uniform election date prescribed by Section 41.001, Election Code, |
|---|
| 15 | 17 | | in November of each even-numbered year. |
|---|
| 16 | 18 | | SECTION 2. Section 8440.101, Special District Local Laws |
|---|
| 17 | 19 | | Code, is amended to read as follows: |

| 18 | 20 | | Sec. 8440.101. GENERAL [MUNICIPAL UTILITY DISTRICT] POWERS |
|---|
| 19 | 21 | | AND DUTIES. (a) The district has the rights, powers, privileges, |
|---|
| 20 | 22 | | functions, and duties: |
|---|
| 21 | 23 | | (1) provided by general law applicable to a municipal |
|---|
| 22 | 24 | | utility district created under Section 59, Article XVI, Texas |
|---|
| 23 | 25 | | Constitution, including Chapters 49, 50, and 54, Water Code; |
|---|
| 24 | 26 | | (2) relating to a road district or road utility |
|---|
| 25 | 27 | | district created under Section 52, Article III, Texas Constitution; |
|---|
| 26 | 28 | | and |
|---|
| 27 | 29 | | (3) relating to the provision of potable and |
|---|
| 28 | 30 | | nonpotable water to the residents and businesses of Travis and Hays |
|---|
| 29 | 31 | | Counties, including the construction, acquisition, operation, and |
|---|
| 30 | 32 | | maintenance of a supply and distribution facility or system[, |
|---|
| 31 | 33 | | applicable to a municipal utility district created under Section |
|---|
| 32 | 34 | | 59, Article XVI, Texas Constitution]. |

| 33 | 35 | | (b) Notwithstanding Subsection (a), the district may not |
|---|
| 34 | 36 | | construct, acquire, operate, or maintain a toll road. |
|---|
| 35 | 37 | | SECTION 3. (a) The legal notice of the intention to |
|---|
| 36 | 38 | | introduce this Act, setting forth the general substance of this |
|---|
| 37 | 39 | | Act, has been published as provided by law, and the notice and a |
|---|
| 38 | 40 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 39 | 41 | | officials, or entities to which they are required to be furnished |
|---|
| 40 | 42 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 41 | 43 | | Government Code. |
|---|
| 42 | 44 | | (b) The governor, one of the required recipients, has |
|---|
| 43 | 45 | | submitted the notice and Act to the Texas Commission on |
|---|
| 44 | 46 | | Environmental Quality. |
|---|
| 45 | 47 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 46 | 48 | | its recommendations relating to this Act with the governor, the |
|---|
| 47 | 49 | | lieutenant governor, and the speaker of the house of |
|---|
| 48 | 50 | | representatives within the required time. |
|---|
| 49 | 51 | | (d) All requirements of the constitution and laws of this |
|---|
| 50 | 52 | | state and the rules and procedures of the legislature with respect |
|---|
| 51 | 53 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 52 | 54 | | and accomplished. |
|---|
| 53 | 55 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 54 | 56 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 55 | 57 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 56 | 58 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 57 | 59 | | Act takes effect September 1, 2017. |
