6	6	AN ACT
7	7	relating to the powers and duties of the Needmore Ranch Municipal
8	8	Utility District No. 1 and the territory of the Hays Trinity
9	9	Groundwater Conservation District and the Barton Springs-Edwards
10	10	Aquifer Conservation District.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 8471.102, Special District Local Laws
13	13	Code, is amended to read as follows:
14	14	Sec. 8471.102. GROUNDWATER CONSERVATION DISTRICT AND
15	15	MUNICIPAL UTILITY DISTRICT POWERS AND DUTIES; CONFLICTS OF LAW.
16	16	(a) The district has the powers and duties provided by the general
17	17	law of this state, including Chapters 36, 49, and 54, Water Code,
18	18	applicable to groundwater conservation districts and municipal
19	19	utility districts created under Section 59, Article XVI, Texas
20	20	Constitution.
21	21	(b) If there is a conflict between Chapters 36 and 54, Water
22	22	Code, Chapter 54 prevails.
23	23	SECTION 2. Section 8802.003, Special District Local Laws
24	24	Code, is amended to read as follows:
25	25	Sec. 8802.003. DISTRICT TERRITORY. (a) The district is
26	26	composed of the territory described by the Texas Water Commission's
27	27	August 15, 1986, order, as that territory may have been modified
28	28	under:
29	29	(1) Subchapter J, Chapter 36, Water Code; or
30	30	(2) other law.
31	31	(b) If the Needmore Ranch Municipal Utility District No. 1
32	32	is confirmed at an election held for that purpose, the territory of
33	33	the Needmore Ranch Municipal Utility District No. 1 is removed from
34	34	the district.
35	35	SECTION 3. Section 8843.004, Special District Local Laws
36	36	Code, is amended to read as follows:
37	37	Sec. 8843.004. DISTRICT TERRITORY. (a) The district's
38	38	boundaries are coextensive with the boundaries of Hays County,
39	39	excluding any area that on September 1, 2001, was within another
40	40	groundwater conservation district with authority to require a
41	41	permit to drill or alter a well for the withdrawal of groundwater,
42	42	unless the district's territory has been modified under:
43	43	(1) Subchapter J, Chapter 36, Water Code; or
44	44	(2) other law.
45	45	(b) If the Needmore Ranch Municipal Utility District No. 1
46	46	is confirmed at an election held for that purpose, the territory of
47	47	the Needmore Ranch Municipal Utility District No. 1 is removed from
48	48	the district.
49	49	SECTION 4. (a) The legal notice of the intention to
50	50	introduce this Act, setting forth the general substance of this
51	51	Act, has been published as provided by law, and the notice and a
52	52	copy of this Act have been furnished to all persons, agencies,
53	53	officials, or entities to which they are required to be furnished
54	54	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
55	55	Government Code.
56	56	(b) The governor, one of the required recipients, has
57	57	submitted the notice and Act to the Texas Commission on
58	58	Environmental Quality.
59	59	(c) The Texas Commission on Environmental Quality has filed
60	60	its recommendations relating to this Act with the governor, the
61	61	lieutenant governor, and the speaker of the house of
62	62	representatives within the required time.
63	63	(d) All requirements of the constitution and laws of this
64	64	state and the rules and procedures of the legislature with respect
65	65	to the notice, introduction, and passage of this Act are fulfilled
66	66	and accomplished.
67	67	SECTION 5. This Act takes effect September 1, 2017.
