66 AN ACT
77 relating to the powers and duties of the Needmore Ranch Municipal
88 Utility District No. 1 and the territory of the Hays Trinity
99 Groundwater Conservation District and the Barton Springs-Edwards
1010 Aquifer Conservation District.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 8471.102, Special District Local Laws
1313 Code, is amended to read as follows:
1414 Sec. 8471.102. GROUNDWATER CONSERVATION DISTRICT AND
1515 MUNICIPAL UTILITY DISTRICT POWERS AND DUTIES; CONFLICTS OF LAW.
1616 (a) The district has the powers and duties provided by the general
1717 law of this state, including Chapters 36, 49, and 54, Water Code,
1818 applicable to groundwater conservation districts and municipal
1919 utility districts created under Section 59, Article XVI, Texas
2020 Constitution.
2121 (b) If there is a conflict between Chapters 36 and 54, Water
2222 Code, Chapter 54 prevails.
2323 SECTION 2. Section 8802.003, Special District Local Laws
2424 Code, is amended to read as follows:
2525 Sec. 8802.003. DISTRICT TERRITORY. (a) The district is
2626 composed of the territory described by the Texas Water Commission's
2727 August 15, 1986, order, as that territory may have been modified
2828 under:
2929 (1) Subchapter J, Chapter 36, Water Code; or
3030 (2) other law.
3131 (b) If the Needmore Ranch Municipal Utility District No. 1
3232 is confirmed at an election held for that purpose, the territory of
3333 the Needmore Ranch Municipal Utility District No. 1 is removed from
3434 the district.
3535 SECTION 3. Section 8843.004, Special District Local Laws
3636 Code, is amended to read as follows:
3737 Sec. 8843.004. DISTRICT TERRITORY. (a) The district's
3838 boundaries are coextensive with the boundaries of Hays County,
3939 excluding any area that on September 1, 2001, was within another
4040 groundwater conservation district with authority to require a
4141 permit to drill or alter a well for the withdrawal of groundwater,
4242 unless the district's territory has been modified under:
4343 (1) Subchapter J, Chapter 36, Water Code; or
4444 (2) other law.
4545 (b) If the Needmore Ranch Municipal Utility District No. 1
4646 is confirmed at an election held for that purpose, the territory of
4747 the Needmore Ranch Municipal Utility District No. 1 is removed from
4848 the district.
4949 SECTION 4. (a) The legal notice of the intention to
5050 introduce this Act, setting forth the general substance of this
5151 Act, has been published as provided by law, and the notice and a
5252 copy of this Act have been furnished to all persons, agencies,
5353 officials, or entities to which they are required to be furnished
5454 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
5555 Government Code.
5656 (b) The governor, one of the required recipients, has
5757 submitted the notice and Act to the Texas Commission on
5858 Environmental Quality.
5959 (c) The Texas Commission on Environmental Quality has filed
6060 its recommendations relating to this Act with the governor, the
6161 lieutenant governor, and the speaker of the house of
6262 representatives within the required time.
6363 (d) All requirements of the constitution and laws of this
6464 state and the rules and procedures of the legislature with respect
6565 to the notice, introduction, and passage of this Act are fulfilled
6666 and accomplished.
6767 SECTION 5. This Act takes effect September 1, 2017.
