| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Subchapter A, Chapter 822, Health and Safety |
|---|
| 9 | 11 | | Code, is amended by adding Section 822.0012 to read as follows: |
|---|
| 10 | 12 | | Sec. 822.0012. ANIMAL CONTROL AUTHORITY IN CERTAIN |
|---|
| 11 | 13 | | MUNICIPALITIES. (a) This section applies only to an incorporated |
|---|
| 12 | 14 | | municipality that has a population of more than 1,000 and that is |
|---|
| 13 | 15 | | the county seat of a county with a population of less than 1,600. |
|---|
| 14 | 16 | | (b) Notwithstanding the definition in Section 822.001(1), |
|---|
| 15 | 17 | | for purposes of this subchapter the police department of a |
|---|
| 16 | 18 | | municipality described by Subsection (a) is the animal control |
|---|
| 17 | 19 | | authority for the municipality in all areas in which a dog is kept |
|---|
| 18 | 20 | | and that are subject to the authority of the police department. |

| 19 | 21 | | SECTION 2. Subchapter D, Chapter 822, Health and Safety |
|---|
| 20 | 22 | | Code, is amended by adding Section 822.0411 to read as follows: |
