57 relating to the powers and duties of the Harris County Municipal
68 Utility District No. 525.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 8326.005(b), Special District Local Laws
911 Code, is amended to read as follows:
1012 (b) The district is created to accomplish the purposes of:
1113 (1) a municipal utility district as provided by
1214 general law and Section 59, Article XVI, Texas Constitution; and
1315 (2) Section 52, Article III, Texas Constitution, that
1416 relate to the construction, acquisition, operation, maintenance,
1517 or improvement of macadamized, graveled, or paved roads [described
1618 by Section 54.234, Water Code,] or improvements, including storm
1719 drainage, in aid of those roads.
1820 SECTION 2. Section 8326.103(a), Special District Local Laws
1921 Code, is amended to read as follows:
2022 (a) Under Section 52, Article III, Texas Constitution, the
2123 district may design, acquire, construct, finance, issue bonds for,
2224 improve, operate, maintain, and convey to this state, a county, or a
2325 municipality for operation and maintenance macadamized, graveled,
2426 or paved roads [described by Section 54.234, Water Code,] or
2527 improvements, including storm drainage, in aid of those roads.
2628 SECTION 3. Subchapter C, Chapter 8326, Special District
2729 Local Laws Code, is amended by adding Section 8326.1045 to read as
2830 follows:
2931 Sec. 8326.1045. ROAD STANDARDS AND REQUIREMENTS. (a) A
3032 road project must meet all applicable construction standards,
3133 zoning and subdivision requirements, and regulations of each
3234 municipality in whose corporate limits or extraterritorial
3335 jurisdiction the road project is located.
3436 (b) If a road project is not located in the corporate limits
3537 or extraterritorial jurisdiction of a municipality, the road
3638 project must meet all applicable construction standards,
3739 subdivision requirements, and regulations of each county in which
3840 the road project is located.
3941 (c) If the state will maintain and operate the road, the
4042 Texas Transportation Commission must approve the plans and
4143 specifications of the road project.
4244 SECTION 4. Section 8326.104, Special District Local Laws
4345 Code, is repealed.
4446 SECTION 5. The Harris County Municipal Utility District
4547 No. 525 retains all the rights, powers, privileges, authority,
4648 duties, and functions that it had before the effective date of this
4749 Act.
4850 SECTION 6. (a) The legislature validates and confirms all
4951 governmental acts and proceedings of the Harris County Municipal
5052 Utility District No. 525 that were taken before the effective date
5153 of this Act.
5254 (b) This section does not apply to any matter that on the
5355 effective date of this Act:
5456 (1) is involved in litigation if the litigation
5557 ultimately results in the matter being held invalid by a final court
5658 judgment; or
5759 (2) has been held invalid by a final court judgment.
5860 SECTION 7. (a) The legal notice of the intention to
5961 introduce this Act, setting forth the general substance of this
6062 Act, has been published as provided by law, and the notice and a
6163 copy of this Act have been furnished to all persons, agencies,
6264 officials, or entities to which they are required to be furnished
6365 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6466 Government Code.
6567 (b) The governor, one of the required recipients, has
6668 submitted the notice and Act to the Texas Commission on
6769 Environmental Quality.
6870 (c) The Texas Commission on Environmental Quality has filed
6971 its recommendations relating to this Act with the governor, the
7072 lieutenant governor, and the speaker of the house of
7173 representatives within the required time.
7274 (d) All requirements of the constitution and laws of this
7375 state and the rules and procedures of the legislature with respect
7476 to the notice, introduction, and passage of this Act are fulfilled
7577 and accomplished.
7678 SECTION 8. This Act takes effect immediately if it receives
7779 a vote of two-thirds of all the members elected to each house, as
7880 provided by Section 39, Article III, Texas Constitution. If this
7981 Act does not receive the vote necessary for immediate effect, this
8082 Act takes effect September 1, 2017.
