| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Section 8326.005(b), Special District Local Laws |
|---|
| 9 | 11 | | Code, is amended to read as follows: |
|---|
| 10 | 12 | | (b) The district is created to accomplish the purposes of: |
|---|
| 11 | 13 | | (1) a municipal utility district as provided by |
|---|
| 12 | 14 | | general law and Section 59, Article XVI, Texas Constitution; and |
|---|
| 13 | 15 | | (2) Section 52, Article III, Texas Constitution, that |
|---|
| 14 | 16 | | relate to the construction, acquisition, operation, maintenance, |
|---|
| 15 | 17 | | or improvement of macadamized, graveled, or paved roads [described |
|---|
| 16 | 18 | | by Section 54.234, Water Code,] or improvements, including storm |
|---|
| 17 | 19 | | drainage, in aid of those roads. |

| 18 | 20 | | SECTION 2. Section 8326.103(a), Special District Local Laws |
|---|
| 19 | 21 | | Code, is amended to read as follows: |
|---|
| 20 | 22 | | (a) Under Section 52, Article III, Texas Constitution, the |
|---|
| 21 | 23 | | district may design, acquire, construct, finance, issue bonds for, |
|---|
| 22 | 24 | | improve, operate, maintain, and convey to this state, a county, or a |
|---|
| 23 | 25 | | municipality for operation and maintenance macadamized, graveled, |
|---|
| 24 | 26 | | or paved roads [described by Section 54.234, Water Code,] or |
|---|
| 25 | 27 | | improvements, including storm drainage, in aid of those roads. |

| 26 | 28 | | SECTION 3. Subchapter C, Chapter 8326, Special District |
|---|
| 27 | 29 | | Local Laws Code, is amended by adding Section 8326.1045 to read as |
|---|
| 28 | 30 | | follows: |
|---|
| 29 | 31 | | Sec. 8326.1045. ROAD STANDARDS AND REQUIREMENTS. (a) A |
|---|
| 30 | 32 | | road project must meet all applicable construction standards, |
|---|
| 31 | 33 | | zoning and subdivision requirements, and regulations of each |
|---|
| 32 | 34 | | municipality in whose corporate limits or extraterritorial |
|---|
| 33 | 35 | | jurisdiction the road project is located. |
|---|
| 34 | 36 | | (b) If a road project is not located in the corporate limits |
|---|
| 35 | 37 | | or extraterritorial jurisdiction of a municipality, the road |
|---|
| 36 | 38 | | project must meet all applicable construction standards, |
|---|
| 37 | 39 | | subdivision requirements, and regulations of each county in which |
|---|
| 38 | 40 | | the road project is located. |
|---|
| 39 | 41 | | (c) If the state will maintain and operate the road, the |
|---|
| 40 | 42 | | Texas Transportation Commission must approve the plans and |
|---|
| 41 | 43 | | specifications of the road project. |
|---|
| 42 | 44 | | SECTION 4. Section 8326.104, Special District Local Laws |
|---|
| 43 | 45 | | Code, is repealed. |
|---|
| 44 | 46 | | SECTION 5. The Harris County Municipal Utility District |
|---|
| 45 | 47 | | No. 525 retains all the rights, powers, privileges, authority, |
|---|
| 46 | 48 | | duties, and functions that it had before the effective date of this |
|---|
| 47 | 49 | | Act. |
|---|
| 48 | 50 | | SECTION 6. (a) The legislature validates and confirms all |
|---|
| 49 | 51 | | governmental acts and proceedings of the Harris County Municipal |
|---|
| 50 | 52 | | Utility District No. 525 that were taken before the effective date |
|---|
| 51 | 53 | | of this Act. |
|---|
| 52 | 54 | | (b) This section does not apply to any matter that on the |
|---|
| 53 | 55 | | effective date of this Act: |
|---|
| 54 | 56 | | (1) is involved in litigation if the litigation |
|---|
| 55 | 57 | | ultimately results in the matter being held invalid by a final court |
|---|
| 56 | 58 | | judgment; or |
|---|
| 57 | 59 | | (2) has been held invalid by a final court judgment. |

| 58 | 60 | | SECTION 7. (a) The legal notice of the intention to |
|---|
| 59 | 61 | | introduce this Act, setting forth the general substance of this |
|---|
| 60 | 62 | | Act, has been published as provided by law, and the notice and a |
|---|
| 61 | 63 | | copy of this Act have been furnished to all persons, agencies, |
|---|
| 62 | 64 | | officials, or entities to which they are required to be furnished |
|---|
| 63 | 65 | | under Section 59, Article XVI, Texas Constitution, and Chapter 313, |
|---|
| 64 | 66 | | Government Code. |
|---|
| 65 | 67 | | (b) The governor, one of the required recipients, has |
|---|
| 66 | 68 | | submitted the notice and Act to the Texas Commission on |
|---|
| 67 | 69 | | Environmental Quality. |
|---|
| 68 | 70 | | (c) The Texas Commission on Environmental Quality has filed |
|---|
| 69 | 71 | | its recommendations relating to this Act with the governor, the |
|---|
| 70 | 72 | | lieutenant governor, and the speaker of the house of |
|---|
| 71 | 73 | | representatives within the required time. |
|---|
| 72 | 74 | | (d) All requirements of the constitution and laws of this |
|---|
| 73 | 75 | | state and the rules and procedures of the legislature with respect |
|---|
| 74 | 76 | | to the notice, introduction, and passage of this Act are fulfilled |
|---|
| 75 | 77 | | and accomplished. |
|---|
| 76 | 78 | | SECTION 8. This Act takes effect immediately if it receives |
|---|
| 77 | 79 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 78 | 80 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 79 | 81 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 80 | 82 | | Act takes effect September 1, 2017. |
