| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Section 411.188(a), Government Code, is amended |
|---|
| 11 | 9 | | to read as follows: |
|---|
| 12 | 10 | | (a) The director by rule shall establish minimum standards |
|---|
| 13 | 11 | | for handgun proficiency and shall develop a course to teach handgun |
|---|
| 14 | 12 | | proficiency and examinations to measure handgun proficiency. The |
|---|
| 15 | 13 | | course to teach handgun proficiency is required for each person who |
|---|
| 16 | 14 | | seeks to obtain a license and must contain training sessions |
|---|
| 17 | 15 | | divided into two parts. One part of the course must be classroom |
|---|
| 18 | 16 | | instruction and the other part must be range instruction and an |
|---|
| 19 | 17 | | actual demonstration by the applicant of the applicant's ability to |
|---|
| 20 | 18 | | safely and proficiently use a handgun. An applicant must be able to |
|---|
| 21 | 19 | | demonstrate, at a minimum, the degree of proficiency that is |
|---|
| 22 | 20 | | required to effectively operate a handgun [of .32 caliber or |
|---|
| 23 | 21 | | above]. The department shall distribute the standards, course |
|---|
| 24 | 22 | | requirements, and examinations on request to any qualified handgun |
|---|
| 25 | 23 | | instructor. |
|---|
| 26 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 27 | 25 | | to an application to obtain or renew a license to carry a handgun |
|---|
| 28 | 26 | | submitted on or after the effective date of this Act. An |
|---|
| 29 | 27 | | application submitted before the effective date of this Act is |
|---|
| 30 | 28 | | governed by the law in effect when the application was submitted, |
|---|
| 31 | 29 | | and the former law is continued in effect for that purpose. |
|---|
| 32 | 30 | | SECTION 3. This Act takes effect September 1, 2017. |
