99 relating to an application made by a peace officer, county jailer,
1010 or state correctional officer to obtain a license to carry a
1111 handgun.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 411.1991, Government Code, is amended by
1414 adding Subsection (b-1) to read as follows:
1515 (b-1) An applicant under this section who is a peace officer
1616 and who complies with Subsection (a-1) and the other requirements
1717 of this subchapter is not required to complete the handgun
1818 proficiency course described by Section 411.188 to obtain a license
1919 under this subchapter.
2020 SECTION 2. Subchapter H, Chapter 411, Government Code, is
2121 amended by adding Sections 411.1993 and 411.1994 to read as
2222 follows:
2323 Sec. 411.1993. COUNTY JAILERS. (a) In this section,
2424 "county jailer" has the meaning assigned by Section 1701.001,
2525 Occupations Code.
2626 (b) A county jailer who holds a county jailer license issued
2727 under Chapter 1701, Occupations Code, may apply for a license under
2828 this subchapter.
2929 (c) An applicant under this section who is a county jailer
3030 shall submit to the department:
3131 (1) the name and job title of the applicant;
3232 (2) a current copy of the applicant's county jailer
3333 license and evidence of employment as a county jailer; and
3434 (3) evidence that the applicant has satisfactorily
3535 completed the preparatory training program required under Section
3636 1701.310, Occupations Code, including the demonstration of weapons
3737 proficiency required as part of the training program under Section
3838 1701.307 of that code.
3939 (d) The department may issue a license under this subchapter
4040 to an applicant under this section if the applicant complies with
4141 Subsection (c) and meets all other requirements of this subchapter,
4242 except that the applicant is not required to complete the range
4343 instruction part of the handgun proficiency course described by
4444 Section 411.188 if the department is satisfied, on the basis of the
4545 evidence provided under Subsection (c)(3), that the applicant is
4646 proficient in the use of handguns.
4747 (e) The department shall waive any fee required for a
4848 license issued under this subchapter to an applicant under this
4949 section.
5050 (f) A license issued to an applicant under this section
5151 expires as provided by Section 411.183.
5252 Sec. 411.1994. STATE CORRECTIONAL OFFICERS. (a) A
5353 correctional officer of the Texas Department of Criminal Justice
5454 may apply for a license under this subchapter.
5555 (b) An applicant under this section shall submit to the
5656 department:
5757 (1) the name and job title of the applicant;
5858 (2) evidence of employment as a correctional officer
5959 of the Texas Department of Criminal Justice; and
6060 (3) evidence that the applicant has satisfactorily
6161 completed the correctional officer training program offered by the
6262 Texas Department of Criminal Justice, including a demonstration of
6363 weapons proficiency.
6464 (c) The department may issue a license under this subchapter
6565 to an applicant under this section if the applicant complies with
6666 Subsection (b) and meets all other requirements of this subchapter,
6767 except that the applicant is not required to complete the range
6868 instruction part of the handgun proficiency course described by
6969 Section 411.188 if the department is satisfied, on the basis of the
7070 evidence provided under Subsection (b)(3), that the applicant is
7171 proficient in the use of handguns.
7272 (d) The department shall waive any fee required for a
7373 license issued under this subchapter to an applicant under this
7474 section.
7575 (e) A license issued to an applicant under this section
7676 expires as provided by Section 411.183.
7777 SECTION 3. Section 411.1952, Government Code, is repealed.
7878 SECTION 4. The change in law made by this Act applies only
7979 to a license issued on or after the effective date of this Act.
8080 SECTION 5. This Act takes effect September 1, 2017.
