12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Section 411.1991, Government Code, is amended by |
---|
14 | 14 | | adding Subsection (b-1) to read as follows: |
---|
15 | 15 | | (b-1) An applicant under this section who is a peace officer |
---|
16 | 16 | | and who complies with Subsection (a-1) and the other requirements |
---|
17 | 17 | | of this subchapter is not required to complete the handgun |
---|
18 | 18 | | proficiency course described by Section 411.188 to obtain a license |
---|
19 | 19 | | under this subchapter. |
---|
20 | 20 | | SECTION 2. Subchapter H, Chapter 411, Government Code, is |
---|
21 | 21 | | amended by adding Sections 411.1993 and 411.1994 to read as |
---|
22 | 22 | | follows: |
---|
23 | 23 | | Sec. 411.1993. COUNTY JAILERS. (a) In this section, |
---|
24 | 24 | | "county jailer" has the meaning assigned by Section 1701.001, |
---|
25 | 25 | | Occupations Code. |
---|
26 | 26 | | (b) A county jailer who holds a county jailer license issued |
---|
27 | 27 | | under Chapter 1701, Occupations Code, may apply for a license under |
---|
28 | 28 | | this subchapter. |
---|
29 | 29 | | (c) An applicant under this section who is a county jailer |
---|
30 | 30 | | shall submit to the department: |
---|
31 | 31 | | (1) the name and job title of the applicant; |
---|
32 | 32 | | (2) a current copy of the applicant's county jailer |
---|
33 | 33 | | license and evidence of employment as a county jailer; and |
---|
34 | 34 | | (3) evidence that the applicant has satisfactorily |
---|
35 | 35 | | completed the preparatory training program required under Section |
---|
36 | 36 | | 1701.310, Occupations Code, including the demonstration of weapons |
---|
37 | 37 | | proficiency required as part of the training program under Section |
---|
38 | 38 | | 1701.307 of that code. |
---|
39 | 39 | | (d) The department may issue a license under this subchapter |
---|
40 | 40 | | to an applicant under this section if the applicant complies with |
---|
41 | 41 | | Subsection (c) and meets all other requirements of this subchapter, |
---|
42 | 42 | | except that the applicant is not required to complete the range |
---|
43 | 43 | | instruction part of the handgun proficiency course described by |
---|
44 | 44 | | Section 411.188 if the department is satisfied, on the basis of the |
---|
45 | 45 | | evidence provided under Subsection (c)(3), that the applicant is |
---|
46 | 46 | | proficient in the use of handguns. |
---|
47 | 47 | | (e) The department shall waive any fee required for a |
---|
48 | 48 | | license issued under this subchapter to an applicant under this |
---|
49 | 49 | | section. |
---|
50 | 50 | | (f) A license issued to an applicant under this section |
---|
51 | 51 | | expires as provided by Section 411.183. |
---|
52 | 52 | | Sec. 411.1994. STATE CORRECTIONAL OFFICERS. (a) A |
---|
53 | 53 | | correctional officer of the Texas Department of Criminal Justice |
---|
54 | 54 | | may apply for a license under this subchapter. |
---|
55 | 55 | | (b) An applicant under this section shall submit to the |
---|
56 | 56 | | department: |
---|
57 | 57 | | (1) the name and job title of the applicant; |
---|
58 | 58 | | (2) evidence of employment as a correctional officer |
---|
59 | 59 | | of the Texas Department of Criminal Justice; and |
---|
60 | 60 | | (3) evidence that the applicant has satisfactorily |
---|
61 | 61 | | completed the correctional officer training program offered by the |
---|
62 | 62 | | Texas Department of Criminal Justice, including a demonstration of |
---|
63 | 63 | | weapons proficiency. |
---|
64 | 64 | | (c) The department may issue a license under this subchapter |
---|
65 | 65 | | to an applicant under this section if the applicant complies with |
---|
66 | 66 | | Subsection (b) and meets all other requirements of this subchapter, |
---|
67 | 67 | | except that the applicant is not required to complete the range |
---|
68 | 68 | | instruction part of the handgun proficiency course described by |
---|
69 | 69 | | Section 411.188 if the department is satisfied, on the basis of the |
---|
70 | 70 | | evidence provided under Subsection (b)(3), that the applicant is |
---|
71 | 71 | | proficient in the use of handguns. |
---|
72 | 72 | | (d) The department shall waive any fee required for a |

77 | 77 | | SECTION 3. Section 411.1952, Government Code, is repealed. |
---|
78 | 78 | | SECTION 4. The change in law made by this Act applies only |
---|
79 | 79 | | to a license issued on or after the effective date of this Act. |
---|
80 | 80 | | SECTION 5. This Act takes effect September 1, 2017. |
