66 AN ACT
77 relating to the age at which a person may purchase aerosol paint.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 485.017, Health and Safety Code, is
1010 amended to read as follows:
1111 Sec. 485.017. SIGNS. A business establishment that sells
1212 an abusable volatile chemical at retail shall display a conspicuous
1313 sign, in English and Spanish, that states the following:
1414 It is unlawful for a person to sell or deliver an
1515 abusable volatile chemical, other than aerosol paint,
1616 to a person under 18 years of age. Except in limited
1717 situations, such an offense is a state jail felony.
1818 It is unlawful for a person to sell or deliver
1919 aerosol paint to a person under 21 years of age. Except
2020 in limited situations, such an offense is a state jail
2121 felony.
2222 It is also unlawful for a person to abuse a
2323 volatile chemical by inhaling, ingesting, applying,
2424 using, or possessing with intent to inhale, ingest,
2525 apply, or use a volatile chemical in a manner designed
2626 to affect the central nervous system. Such an offense
2727 is a Class B misdemeanor.
2828 SECTION 2. Section 485.019(b), Health and Safety Code, is
2929 amended to read as follows:
3030 (b) This section does not apply to a business establishment
3131 that has in place a computerized checkout system at the point of
3232 sale for merchandise that alerts the cashier that a person
3333 purchasing aerosol paint must be over 21 [18] years of age.
3434 SECTION 3. The heading to Section 485.032, Health and
3535 Safety Code, is amended to read as follows:
3636 Sec. 485.032. PROHIBITED DELIVERY [TO A MINOR].
3737 SECTION 4. Section 485.032, Health and Safety Code, is
3838 amended by amending Subsections (a) and (c) and adding Subsections
3939 (a-1) and (c-1) to read as follows:
4040 (a) A person commits an offense if the person knowingly
4141 delivers an abusable volatile chemical, other than aerosol paint,
4242 to a person who is younger than 18 years of age.
4343 (a-1) A person commits an offense if the person knowingly
4444 delivers aerosol paint to a person who is younger than 21 years of
4545 age.
4646 (c) It is an affirmative defense to prosecution under
4747 Subsection (a) [this section] that:
4848 (1) the actor [person making the delivery] is at least
4949 18 years of age and has [an adult having] supervisory
5050 responsibility over the person younger than 18 years of age and:
5151 (A) the actor [adult] permits the use of the
5252 abusable volatile chemical only under the actor's [adult's] direct
5353 supervision and in the actor's [adult's] presence and only for its
5454 intended purpose; and
5555 (B) the actor [adult] removes the chemical from
5656 the person younger than 18 years of age on completion of that use;
5757 or
5858 (2) the person to whom the abusable volatile chemical
5959 was delivered presented to the actor [defendant] an apparently
6060 valid Texas driver's license or an identification certificate,
6161 issued by the Department of Public Safety of the State of Texas and
6262 containing a physical description consistent with the person's
6363 appearance, that purported to establish that the person was 18
6464 years of age or older.
6565 (c-1) It is an affirmative defense to prosecution under
6666 Subsection (a-1) that:
6767 (1) the actor is at least 21 years of age and has
6868 supervisory responsibility over the person younger than 21 years of
6969 age and:
7070 (A) the actor permits the use of the aerosol
7171 paint only under the actor's direct supervision and in the actor's
7272 presence and only for its intended purpose; and
7373 (B) the actor removes the aerosol paint from the
7474 person younger than 21 years of age on completion of that use; or
7575 (2) the person to whom the aerosol paint was delivered
7676 presented to the actor an apparently valid Texas driver's license
7777 or an identification certificate, issued by the Department of
7878 Public Safety of the State of Texas and containing a physical
7979 description consistent with the person's appearance, that
8080 purported to establish that the person was 21 years of age or older.
8181 SECTION 5. Section 485.035, Health and Safety Code, is
8282 amended by amending Subsection (a) and adding Subsection (a-1) to
8383 read as follows:
8484 (a) A person commits an offense if the person sells an
8585 abusable volatile chemical, other than aerosol paint, in violation
8686 of Section 485.011 and the purchaser is 18 years of age or older.
8787 (a-1) A person commits an offense if the person sells
8888 aerosol paint in violation of Section 485.011 and the purchaser is
8989 21 years of age or older.
9090 SECTION 6. (a) The changes in law made by this Act to
9191 Chapter 485, Health and Safety Code, apply only to an offense
9292 committed on or after the effective date of this Act. For purposes
9393 of this subsection, an offense is committed before the effective
9494 date of this Act if any element of the offense occurs before that
9595 date.
9696 (b) An offense committed before the effective date of this
9797 Act is governed by the law in effect on the date the offense was
9898 committed, and the former law is continued in effect for that
9999 purpose.
100100 SECTION 7. This Act takes effect September 1, 2017.
