13 | 13 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 14 | | SECTION 1. Subchapter C, Chapter 17, Business & Commerce |
---|
15 | 15 | | Code, is repealed. |
---|
16 | 16 | | SECTION 2. An offense under Section 17.22, Business & |
---|
17 | 17 | | Commerce Code, may not be prosecuted after the effective date of |
---|
18 | 18 | | this Act. If on the effective date of this Act a criminal action is |
---|
19 | 19 | | pending for an offense under Section 17.22, Business & Commerce |
---|
20 | 20 | | Code, the action is dismissed on that date. However, a final |
---|
21 | 21 | | conviction for an offense under Section 17.22, Business & Commerce |
---|
22 | 22 | | Code, that exists on the effective date of this Act is unaffected by |
---|
23 | 23 | | this Act. |
---|
24 | 24 | | SECTION 3. This Act takes effect immediately if it receives |
---|
25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
---|
26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
---|
28 | 28 | | Act takes effect September 1, 2017. |
