66 AN ACT
77 relating to eligibility for certain higher education grant
88 programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter M, Chapter 56, Education Code, is
1111 amended by adding Section 56.3031 to read as follows:
1212 Sec. 56.3031. FINANCIAL NEED. (a) The coordinating board
1313 by rule shall establish financial need requirements for applicants
1414 to demonstrate eligibility to receive initial or subsequent TEXAS
1515 grants under this subchapter.
1616 (b) The rules must require each applicant to demonstrate
1717 eligibility for federal financial aid but may not require the
1818 applicant to meet a financial need requirement applicable to a
1919 particular federal financial aid program.
2020 (c) Section 56.3045(b)(2) does not apply to the eligibility
2121 requirement described by Subsection (b).
2222 SECTION 2. Section 56.304(a), Education Code, is amended to
2323 read as follows:
2424 (a) To be eligible initially for a TEXAS grant, a person who
2525 graduated from high school before May 1, 2013, must:
2626 (1) be a resident of this state as determined by
2727 coordinating board rules;
2828 (2) meet either of the following academic
2929 requirements:
3030 (A) be a graduate of a public or accredited
3131 private high school in this state who graduated not earlier than the
3232 1998-1999 school year and who completed the recommended or advanced
3333 high school curriculum established under Section 28.002 or 28.025
3434 or its equivalent; or
3535 (B) have received an associate degree from a
3636 public or private institution of higher education not earlier than
3737 May 1, 2001;
3838 (3) meet financial need requirements established [as
3939 defined] by the coordinating board under Section 56.3031;
4040 (4) be enrolled in a baccalaureate degree program at
4141 an eligible institution;
4242 (5) be enrolled as:
4343 (A) an entering undergraduate student for at
4444 least three-fourths of a full course load for an entering
4545 undergraduate student, as determined by the coordinating board, not
4646 later than the 16th month after the date of the person's graduation
4747 from high school; or
4848 (B) an entering student for at least
4949 three-fourths of a full course load for an undergraduate student as
5050 determined by the coordinating board, not later than the 12th month
5151 after the month the person receives an associate degree from a
5252 public or private institution of higher education;
5353 (6) have applied for any available financial aid or
5454 assistance; and
5555 (7) comply with any additional nonacademic
5656 requirement adopted by the coordinating board under this
5757 subchapter.
5858 SECTION 3. Section 56.3041(a), Education Code, is amended
5959 to read as follows:
6060 (a) To be eligible initially for a TEXAS grant, a person
6161 graduating from high school on or after May 1, 2013, and enrolling
6262 in an eligible institution must:
6363 (1) be a resident of this state as determined by
6464 coordinating board rules;
6565 (2) meet the academic requirements prescribed by
6666 Paragraph (A), (B), (C), or (D) as follows:
6767 (A) be a graduate of a public or accredited
6868 private high school in this state who completed the foundation high
6969 school program established under Section 28.025 or its equivalent
7070 and have accomplished any two or more of the following:
7171 (i) successful completion of the course
7272 requirements of the international baccalaureate diploma program or
7373 earning of the equivalent of at least 12 semester credit hours of
7474 college credit in high school through courses described in Sections
7575 28.009(a)(1), (2), and (3);
7676 (ii) satisfaction of the Texas Success
7777 Initiative (TSI) college readiness benchmarks prescribed by the
7878 coordinating board under Section 51.3062(f) on any assessment
7979 instrument designated by the coordinating board under Section
8080 51.3062(c) or qualification for an exemption as described by
8181 Section 51.3062(p), (q), or (q-1);
8282 (iii) graduation in the top one-third of
8383 the person's high school graduating class or graduation from high
8484 school with a grade point average of at least 3.0 on a four-point
8585 scale or the equivalent; or
8686 (iv) completion for high school credit of
8787 at least one advanced mathematics course following the successful
8888 completion of an Algebra II course or at least one advanced career
8989 and technical or technology applications course;
9090 (B) have received an associate degree from a
9191 public or private institution of higher education;
9292 (C) be an undergraduate student who has:
9393 (i) previously attended another
9494 institution of higher education;
9595 (ii) received an initial Texas Educational
9696 Opportunity Grant under Subchapter P for the 2014 fall semester or a
9797 subsequent academic term;
9898 (iii) completed at least 24 semester credit
9999 hours at any institution or institutions of higher education; and
100100 (iv) earned an overall grade point average
101101 of at least 2.5 on a four-point scale or the equivalent on all
102102 course work previously attempted; or
103103 (D) if sufficient money is available, meet the
104104 eligibility criteria described by Section 56.304(a)(2)(A);
105105 (3) meet financial need requirements established by
106106 the coordinating board under Section 56.3031;
107107 (4) be enrolled in an undergraduate degree or
108108 certificate program at an eligible institution;
109109 (5) except as provided under rules adopted under
110110 Section 56.304(h), be enrolled as:
111111 (A) an entering undergraduate student for at
112112 least three-fourths of a full course load, as determined by the
113113 coordinating board, not later than the 16th month after the
114114 calendar month in which the person graduated from high school;
115115 (B) an entering undergraduate student who
116116 entered military service not later than the first anniversary of
117117 the date the person graduated from high school and who enrolled for
118118 at least three-fourths of a full course load, as determined by the
119119 coordinating board, at the eligible institution not later than 12
120120 months after being honorably discharged from military service;
121121 (C) a continuing undergraduate student for at
122122 least three-fourths of a full course load, as determined by the
123123 coordinating board, not later than the 12th month after the
124124 calendar month in which the person received an associate degree
125125 from a public or private institution of higher education; or
126126 (D) an undergraduate student described by
127127 Subdivision (2)(C) who has never previously received a TEXAS grant;
128128 (6) have applied for any available financial aid or
129129 assistance; and
130130 (7) comply with any additional nonacademic
131131 requirements adopted by the coordinating board under this
132132 subchapter.
133133 SECTION 4. Section 56.305(a), Education Code, is amended to
134134 read as follows:
135135 (a) After initially qualifying for a TEXAS grant, a person
136136 may continue to receive a TEXAS grant during each semester or term
137137 in which the person is enrolled at an eligible institution only if
138138 the person:
139139 (1) meets financial need requirements as established
140140 [defined] by the coordinating board under Section 56.3031;
141141 (2) is enrolled in a baccalaureate degree program at
142142 an eligible institution;
143143 (3) is enrolled for at least three-fourths of a full
144144 course load for an undergraduate student, as determined by the
145145 coordinating board;
146146 (4) makes satisfactory academic progress toward a
147147 baccalaureate degree; and
148148 (5) complies with any additional nonacademic
149149 requirement adopted by the coordinating board.
150150 SECTION 5. Subchapter D, Chapter 56, Education Code, is
151151 amended by adding Section 56.4031 to read as follows:
152152 Sec. 56.4031. FINANCIAL NEED. (a) The coordinating board
153153 by rule shall establish financial need requirements for applicants
154154 to demonstrate eligibility to receive initial or subsequent grants
155155 under this subchapter.
156156 (b) The rules must require each applicant to demonstrate
157157 eligibility for federal financial aid but may not require the
158158 applicant to meet a financial need requirement applicable to a
159159 particular federal financial aid program.
160160 SECTION 6. Section 56.404(a), Education Code, is amended to
161161 read as follows:
162162 (a) To be eligible initially for a grant under the grant
163163 program, a person must:
164164 (1) be a resident of this state as determined by
165165 coordinating board rules;
166166 (2) meet financial need requirements established [as
167167 defined] by the coordinating board under Section 56.4031;
168168 (3) be enrolled in an associate degree or certificate
169169 program at an eligible institution;
170170 (4) be enrolled as an entering student for at least
171171 one-half of a full course load for an entering student in the
172172 associate degree or certificate program, as determined by the
173173 coordinating board;
174174 (5) have applied for any available financial aid or
175175 assistance; and
176176 (6) comply with any additional nonacademic
177177 requirement adopted by the coordinating board under this
178178 subchapter.
179179 SECTION 7. Section 56.405(a), Education Code, is amended to
180180 read as follows:
181181 (a) After initially qualifying for a grant under this
182182 subchapter, a person may continue to receive a grant under this
183183 subchapter during each semester or term in which the person is
184184 enrolled at an eligible institution only if the person:
185185 (1) meets financial need requirements established [as
186186 defined] by the coordinating board under Section 56.4031;
187187 (2) is enrolled in an associate degree or certificate
188188 program at an eligible institution;
189189 (3) is enrolled for at least one-half of a full course
190190 load for a student in an associate degree or certificate program, as
191191 determined by the coordinating board;
192192 (4) makes satisfactory academic progress toward an
193193 associate degree or certificate; and
194194 (5) complies with any additional nonacademic
195195 requirement adopted by the coordinating board.
196196 SECTION 8. The changes in law made by this Act in adding
197197 Sections 56.3031 and 56.4031, Education Code, apply beginning with
198198 initial or subsequent grants awarded for the 2017 fall semester.
199199 Initial or subsequent grants awarded for a semester or term before
200200 the 2017 fall semester are governed by the applicable law in effect
201201 immediately before the effective date of this Act, and the former
202202 law is continued in effect for that purpose.
203203 SECTION 9. This Act takes effect immediately if it receives
204204 a vote of two-thirds of all the members elected to each house, as
205205 provided by Section 39, Article III, Texas Constitution. If this
206206 Act does not receive the vote necessary for immediate effect, this
207207 Act takes effect September 1, 2017.
