5	5	A BILL TO BE ENTITLED
6	6	AN ACT
7	7	relating to abolishing the Major Events Trust fund, the Events
8	8	trust fund, and the Motor Sports Racing trust fund.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Sections 1(1-a), (2), and (8), Chapter 1507
11	11	(S.B. 456), Acts of the 76th Legislature, Regular Session, 1999
12	12	(Article 5190.14, Vernon's Texas Civil Statutes), are amended to
13	13	read as follows:
14	14	(1-a) "Endorsing county" means an endorsing county for
15	15	purposes of Section 5[, 5A, 5B, or 5C] of this Act.
16	16	(2) "Endorsing municipality" means an endorsing
17	17	municipality for purposes of Section 4 or [,] 5[, 5A, 5B, or 5C] of
18	18	this Act.
19	19	(8) "Site selection organization" means a site
20	20	selection organization as defined by Section 5 [Sections 5, 5A, and
21	21	5C] of this Act.
22	22	SECTION 2. Section 1(3), Chapter 1507 (S.B. 456), Acts of
23	23	the 76th Legislature, Regular Session, 1999 (Article 5190.14,
24	24	Vernon's Texas Civil Statutes), as amended by Chapter 814 (S.B.
25	25	275), Acts of the 78th Legislature, Regular Session, 2003, is
26	26	amended to read as follows:
27	27	(3) "Games" means the Pan American Games or [,] the
28	28	Olympic Games[, the Super Bowl, the National Collegiate Athletic
29	29	Association Final Four, the National Basketball Association
30	30	All-Star Game, the National Hockey League All-Star Game, the Major
31	31	League Baseball All-Star Game, the National Collegiate Athletic
32	32	Association Bowl Championship Series Games, the World Cup Soccer
33	33	Games, or the World Games]. The term includes the events and
34	34	activities related to the games.
35	35	SECTION 3. Section 7(a), Chapter 1507 (S.B. 456), Acts of
36	36	the 76th Legislature, Regular Session, 1999 (Article 5190.14,
37	37	Vernon's Texas Civil Statutes), is amended to read as follows:
38	38	(a) The department shall review requests from a local
39	39	organizing committee, endorsing municipality, or endorsing county
40	40	that the department, on behalf of the state, enter into a games
41	41	support contract that is required by a site selection organization
42	42	in connection with the committee's, municipality's, or county's bid
43	43	to host any of the games. [This section does not affect or apply to
44	44	an event support contract under Section 5A, 5B, or 5C of this Act to
45	45	which the department is not a party.]
46	46	SECTION 4. (a) On September 1, 2017:
47	47	(1) Sections 1(2-a), 5A, 5B, and 5C, Chapter 1507
48	48	(S.B. 456), Acts of the 76th Legislature, Regular Session, 1999
49	49	(Article 5190.14, Vernon's Texas Civil Statutes), are repealed; and
50	50	(2) each fund established under Sections 1(2-a), 5A,
51	51	5B, and 5C, Chapter 1507 (S.B. 456), Acts of the 76th Legislature,
52	52	Regular Session, 1999 (Article 5190.14, Vernon's Texas Civil
53	53	Statutes), is abolished.
54	54	(b) The applicable provisions of Sections 5A, 5B, and 5C,
55	55	Chapter 1507 (S.B. 456), Acts of the 76th Legislature, Regular
56	56	Session, 1999 (Article 5190.14, Vernon's Texas Civil Statutes), as
57	57	those sections existed immediately before the effective date of
58	58	this Act, including any fund established under those sections,
59	59	remain in effect as those provisions apply in relation to the
60	60	particular events described by this subsection until all money from
61	61	the fund for the particular event has been disbursed and all
62	62	obligations under an event support contract for the particular
63	63	event have been satisfied. This subsection applies only if, before
64	64	the effective date of this Act:
65	65	(1) pursuant to an application by a local organizing
66	66	committee, endorsing municipality, or endorsing county, a site
67	67	selection organization selects a site in this state for a
68	68	particular event to which Section 5A, 5B, or 5C, Chapter 1507,
69	69	applies; and
70	70	(2) one or more event support contracts for the
71	71	particular event have been entered into.
72	72	SECTION 5. The repeal by this Act of Sections 5A, 5B, and
73	73	5C, Chapter 1507 (S.B. 456), Acts of the 76th Legislature, Regular
74	74	Session, 1999 (Article 5190.14, Vernon's Texas Civil Statutes),
75	75	does not apply to an offense committed under Chapter 1507 before
76	76	September 1, 2017. An offense committed before September 1, 2017,
77	77	is governed by the law as it existed on the date the offense was
78	78	committed, and the former law is continued in effect for that
79	79	purpose. For purposes of this section, an offense was committed
80	80	before September 1, 2017, if any element of the offense occurred
81	81	before that date.
82	82	SECTION 6. This Act takes effect September 1, 2017.
