66 AN ACT
77 relating to the required vote by a presidential elector; providing
88 a civil penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 192.002, Election Code, is amended by
1111 adding Subsection (c) to read as follows:
1212 (c) A person who violates Section 192.009(a) is ineligible
1313 to serve as an elector in all subsequent elections.
1414 SECTION 2. Subchapter A, Chapter 192, Election Code, is
1515 amended by adding Section 192.009 to read as follows:
1616 Sec. 192.009. REQUIRED VOTE BY ELECTOR. (a) At the meeting
1717 of electors, an elector shall vote for the candidates for president
1818 and vice-president receiving the most votes in the general election
1919 for state and county officers.
2020 (b) An elector who violates Subsection (a) is liable to this
2121 state for a civil penalty of $5,000.
2222 SECTION 3. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2017.
