9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 192.002, Election Code, is amended by | |
11 | 11 | adding Subsection (c) to read as follows: | |
12 | 12 | (c) A person who violates Section 192.009(a) is ineligible | |
13 | 13 | to serve as an elector in all subsequent elections. | |
14 | 14 | SECTION 2. Subchapter A, Chapter 192, Election Code, is | |
15 | 15 | amended by adding Section 192.009 to read as follows: | |
16 | 16 | Sec. 192.009. REQUIRED VOTE BY ELECTOR. (a) At the meeting | |
17 | 17 | of electors, an elector shall vote for the candidates for president | |
18 | 18 | and vice-president receiving the most votes in the general election | |
19 | 19 | for state and county officers. | |
20 | 20 | (b) An elector who violates Subsection (a) is liable to this | |
21 | 21 | state for a civil penalty of $5,000. | |
22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2017. |
