55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the admission policy of an open-enrollment charter
88 school.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 12.111(a), Education Code, is amended to
1111 read as follows:
1212 (a) Each charter granted under this subchapter must:
1313 (1) describe the educational program to be offered,
1414 which must include the required curriculum as provided by Section
1515 28.002;
1616 (2) provide that continuation of the charter is
1717 contingent on the status of the charter as determined under Section
1818 12.1141 or 12.115 or under Subchapter E, Chapter 39;
1919 (3) specify the academic, operational, and financial
2020 performance expectations by which a school operating under the
2121 charter will be evaluated, which must include applicable elements
2222 of the performance frameworks adopted under Section 12.1181;
2323 (4) specify:
2424 (A) any basis, in addition to a basis specified
2525 by this subchapter or Subchapter E, Chapter 39, on which the charter
2626 may be revoked, renewal of the charter may be denied, or the charter
2727 may be allowed to expire; and
2828 (B) the standards for evaluation of a school
2929 operating under the charter for purposes of charter renewal, denial
3030 of renewal, expiration, revocation, or other intervention in
3131 accordance with Section 12.1141 or 12.115 or Subchapter E, Chapter
3232 39, as applicable;
3333 (5) prohibit discrimination in admission policy on the
3434 basis of sex, national origin, ethnicity, religion, disability,
3535 academic, artistic, or athletic ability, or the district the child
3636 would otherwise attend in accordance with this code, although the
3737 charter may:
3838 (A) provide for the exclusion of a student who
3939 has a documented history of a criminal offense, a juvenile court
4040 adjudication, or a placement in a disciplinary alternative
4141 education program or a juvenile justice alternative education
4242 program [discipline problems under Subchapter A, Chapter 37]; and
4343 (B) provide for an admission policy that requires
4444 a student to demonstrate artistic ability if the school specializes
4545 in performing arts;
4646 (6) specify the grade levels to be offered;
4747 (7) describe the governing structure of the program,
4848 including:
4949 (A) the officer positions designated;
5050 (B) the manner in which officers are selected and
5151 removed from office;
5252 (C) the manner in which members of the governing
5353 body of the school are selected and removed from office;
5454 (D) the manner in which vacancies on that
5555 governing body are filled;
5656 (E) the term for which members of that governing
5757 body serve; and
5858 (F) whether the terms are to be staggered;
5959 (8) specify the powers or duties of the governing body
6060 of the school that the governing body may delegate to an officer;
6161 (9) specify the manner in which the school will
6262 distribute to parents information related to the qualifications of
6363 each professional employee of the program, including any
6464 professional or educational degree held by each employee, a
6565 statement of any certification under Subchapter B, Chapter 21, held
6666 by each employee, and any relevant experience of each employee;
6767 (10) describe the process by which the person
6868 providing the program will adopt an annual budget;
6969 (11) describe the manner in which an annual audit of
7070 the financial and programmatic operations of the program is to be
7171 conducted, including the manner in which the person providing the
7272 program will provide information necessary for the school district
7373 in which the program is located to participate, as required by this
7474 code or by commissioner rule, in the Public Education Information
7575 Management System (PEIMS);
7676 (12) describe the facilities to be used;
7777 (13) describe the geographical area served by the
7878 program;
7979 (14) specify any type of enrollment criteria to be
8080 used;
8181 (15) provide information, as determined by the
8282 commissioner, relating to any management company that will provide
8383 management services to a school operating under the charter; and
8484 (16) specify that the governing body of an
8585 open-enrollment charter school accepts and may not delegate
8686 ultimate responsibility for the school, including the school's
8787 academic performance and financial and operational viability, and
8888 is responsible for overseeing any management company providing
8989 management services for the school and for holding the management
9090 company accountable for the school's performance.
9191 SECTION 2. The changes in law made by this Act apply only to
9292 a charter granted or renewed on or after the effective date of this
9393 Act.
9494 SECTION 3. This Act takes effect September 1, 2017.
