55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the carrying of a concealed handgun on the premises of
88 certain businesses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 11.61(e), Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 (e) Except as provided by Subsection (f) or (i), the
1313 commission or administrator shall cancel an original or renewal
1414 permit if it is found, after notice and hearing, that the permittee
1515 knowingly allowed a person to possess a firearm in a building on the
1616 licensed premises. This subsection does not apply to a person:
1717 (1) who holds a security officer commission issued
1818 under Chapter 1702, Occupations Code, if:
1919 (A) the person is engaged in the performance of
2020 the person's duties as a security officer;
2121 (B) the person is wearing a distinctive uniform;
2222 and
2323 (C) the weapon is in plain view;
2424 (2) who is a peace officer;
2525 (3) who is a permittee or an employee of a permittee if
2626 the person is supervising the operation of the premises; or
2727 (4) who:
2828 (A) on the premises of a business described by
2929 Section 46.035(b)(1), Penal Code, that displays the sign described
3030 by Section 411.204(c-1), Government Code, possesses a concealed
3131 handgun the person is licensed to carry under Subchapter H, Chapter
3232 411, Government Code; or
3333 (B) on the premises of a business other than a
3434 business described by Section 46.035(b)(1), Penal Code, possesses a
3535 handgun the person is licensed to carry under Subchapter H, Chapter
3636 411, Government Code [, unless the person is on the premises of a
3737 business described by Section 46.035(b)(1), Penal Code].
3838 SECTION 2. Section 61.71(f), Alcoholic Beverage Code, is
3939 amended to read as follows:
4040 (f) Except as provided by Subsection (g) or (j), the
4141 commission or administrator shall cancel an original or renewal
4242 dealer's on-premises or off-premises license if it is found, after
4343 notice and hearing, that the licensee knowingly allowed a person to
4444 possess a firearm in a building on the licensed premises. This
4545 subsection does not apply to a person:
4646 (1) who holds a security officer commission issued
4747 under Chapter 1702, Occupations Code, if:
4848 (A) the person is engaged in the performance of
4949 the person's duties as a security officer;
5050 (B) the person is wearing a distinctive uniform;
5151 and
5252 (C) the weapon is in plain view;
5353 (2) who is a peace officer;
5454 (3) who is a licensee or an employee of a licensee if
5555 the person is supervising the operation of the premises; or
5656 (4) who:
5757 (A) on the premises of a business described by
5858 Section 46.035(b)(1), Penal Code, that displays the sign described
5959 by Section 411.204(c-1), Government Code, possesses a concealed
6060 handgun the person is licensed to carry under Subchapter H, Chapter
6161 411, Government Code; or
6262 (B) on the premises of a business other than a
6363 business described by Section 46.035(b)(1), Penal Code, possesses a
6464 handgun the person is licensed to carry under Subchapter H, Chapter
6565 411, Government Code [, unless the person is on the premises of a
6666 business described by Section 46.035(b)(1), Penal Code].
6767 SECTION 3. Section 411.204, Government Code, is amended by
6868 amending Subsection (a) and adding Subsection (c-1) to read as
6969 follows:
7070 (a) A business that has a permit or license issued under
7171 Chapter 25, 28, 32, 69, or 74, Alcoholic Beverage Code, and that
7272 derives 51 percent or more of its income from the sale of alcoholic
7373 beverages for on-premises consumption as determined by the Texas
7474 Alcoholic Beverage Commission under Section 104.06, Alcoholic
7575 Beverage Code, shall prominently display at each entrance to the
7676 business premises a sign that complies with the requirements of
7777 Subsection (c) or (c-1).
7878 (c-1) A business to which Subsection (a) applies may
7979 display, in lieu of the sign described by Subsection (c), a sign
8080 that gives notice in both English and Spanish that it is unlawful
8181 for a person licensed under this subchapter to carry a partially or
8282 wholly visible handgun on the premises. The sign must otherwise
8383 comply with the requirements of Subsection (c).
8484 SECTION 4. Section 46.035, Penal Code, is amended by
8585 amending Subsection (k) and adding Subsection (m) to read as
8686 follows:
8787 (k) It is a defense to prosecution under Subsection (b)(1)
8888 that the actor was not given effective notice under Section
8989 411.204(c) or (c-1), Government Code, that the actor's conduct was
9090 unlawful.
9191 (m) It is an exception to the application of Subsection
9292 (b)(1) that the actor, at the time of the commission of the offense,
9393 was carrying a concealed handgun on the premises of a business that
9494 displayed the sign described by Section 411.204(c-1), Government
9595 Code.
9696 SECTION 5. The change in law made by this Act to Section
9797 46.035, Penal Code, applies only to an offense committed on or after
9898 the effective date of this Act. An offense committed before the
9999 effective date of this Act is governed by the law in effect on the
100100 date the offense was committed, and the former law is continued in
101101 effect for that purpose. For purposes of this section, an offense
102102 was committed before the effective date of this Act if any element
103103 of the offense occurred before that date.
104104 SECTION 6. This Act takes effect September 1, 2017.
