| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 1, Penal Code, is amended by adding |
|---|
| 11 | 11 | | Section 1.10 to read as follows: |
|---|
| 12 | 12 | | Sec. 1.10. ENFORCEMENT OF CERTAIN FEDERAL LAWS REGULATING |
|---|
| 13 | 13 | | FIREARMS, FIREARM ACCESSORIES, AND FIREARM AMMUNITION. (a) In |
|---|
| 14 | 14 | | this section: |
|---|
| 15 | 15 | | (1) "Firearm" has the meaning assigned by Section |
|---|
| 16 | 16 | | 46.01. |
|---|
| 17 | 17 | | (2) "Firearm accessory" means an item that is used in |
|---|
| 18 | 18 | | conjunction with or mounted on a firearm but is not essential to the |
|---|
| 19 | 19 | | basic function of a firearm. The term includes a detachable firearm |
|---|
| 20 | 20 | | magazine. |
|---|
| 21 | 21 | | (b) Except as provided by Subsection (c), an agency of this |
|---|
| 22 | 22 | | state or a political subdivision of this state, and a law |
|---|
| 23 | 23 | | enforcement officer or other person employed by an agency of this |
|---|
| 24 | 24 | | state or a political subdivision of this state, may not contract |
|---|
| 25 | 25 | | with or in any other manner provide assistance to a federal agency |
|---|
| 26 | 26 | | or official with respect to the enforcement of a federal statute, |
|---|
| 27 | 27 | | order, rule, or regulation purporting to regulate a firearm, a |
|---|
| 28 | 28 | | firearm accessory, or firearm ammunition if the statute, order, |
|---|
| 29 | 29 | | rule, or regulation imposes a prohibition, restriction, or other |
|---|
| 30 | 30 | | regulation, such as a capacity or size limitation or a registration |
|---|
| 31 | 31 | | requirement, that does not exist under the laws of this state. |
|---|
| 32 | 32 | | (c) This section does not prohibit compliance with the |
|---|
| 33 | 33 | | national instant criminal background check system in the manner |
|---|
| 34 | 34 | | required by 18 U.S.C. Section 922. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2017. |
