66 AN ACT
77 relating to required provision of workers' compensation insurance
88 coverage for employees of building and construction contractors and
99 subcontractors.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. The heading to Section 406.096, Labor Code, is
1212 amended to read as follows:
1313 Sec. 406.096. REQUIRED PROVISION OF COVERAGE FOR EMPLOYEES
1414 OF [CERTAIN] BUILDING OR CONSTRUCTION CONTRACTORS AND
1515 SUBCONTRACTORS.
1616 SECTION 2. Section 406.096, Labor Code, is amended by
1717 amending Subsections (a), (b), and (c) and adding Subsection (a-1)
1818 to read as follows:
1919 (a) A contractor shall provide workers' compensation
2020 insurance coverage for each employee of the contractor. A
2121 subcontractor shall provide workers' compensation insurance
2222 coverage for each employee of the subcontractor.
2323 (a-1) A governmental entity that enters into a building or
2424 construction contract shall require the contractor to:
2525 (1) certify in writing that the contractor provides
2626 workers' compensation insurance coverage for each employee of the
2727 contractor employed on the public project; and
2828 (2) if the contractor uses a subcontractor on the
2929 public project, provide a written certification, submitted by each
3030 subcontractor, that the subcontractor provides workers'
3131 compensation insurance coverage for each employee of the
3232 subcontractor employed on the public project.
3333 (b) Each subcontractor on a [the] public project shall
3434 provide the [such a] certificate described by Subsection (a-1)(2)
3535 [relating to coverage of the subcontractor's employees] to the
3636 general contractor, who shall provide the subcontractor's
3737 certificate to the governmental entity.
3838 (c) A contractor or subcontractor may provide [who has a
3939 contract that requires] workers' compensation insurance coverage
4040 [may provide the coverage] through a group plan or other method. If
4141 the contractor enters into a contract with a governmental entity
4242 for a public project, the coverage provided by the contractor and,
4343 if applicable, by each subcontractor must be satisfactory to the
4444 governing body of the governmental entity.
4545 SECTION 3. The change in law made by this Act applies only
4646 to a contract for building or construction that is entered into on
4747 or after the effective date of this Act. A contract entered into
4848 before the effective date of this Act is governed by the law in
4949 effect on the date the contract was entered into, and the former law
5050 is continued in effect for that purpose.
5151 SECTION 4. This Act takes effect September 1, 2017.
