66 AN ACT
77 relating to safety training for employees performing construction
88 work under a contract with a governmental entity; providing
99 administrative penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter Z, Chapter 2252, Government Code, is
1212 amended by adding Section 2252.902 to read as follows:
1313 Sec. 2252.902. SAFETY TRAINING REQUIRED FOR EMPLOYEES
1414 PERFORMING CONSTRUCTION WORK UNDER CONTRACTS WITH GOVERNMENTAL
1515 ENTITIES. (a) In this section:
1616 (1) "Advanced construction safety training" means a
1717 construction and general industry safety training class approved by
1818 the federal Occupational Safety and Health Administration that is
1919 at least 30 hours in duration.
2020 (2) "Construction contract" means a contract or
2121 agreement for the performance of general construction for a
2222 governmental entity.
2323 (3) "Construction safety training" means a
2424 construction and general industry safety training class approved by
2525 the federal Occupational Safety and Health Administration that is
2626 at least 10 hours in duration.
2727 (4) "Contractor" means a person, firm, or corporation
2828 contracting with a governmental entity for general construction.
2929 (5) "Employee" means an individual paid by a
3030 contractor or subcontractor to perform general construction work or
3131 services.
3232 (6) "General construction" means:
3333 (A) erecting or preparing to erect a structure,
3434 including a building, bridge, roadway, public utility facility, or
3535 related structure;
3636 (B) remodeling, extending, repairing, or
3737 demolishing a structure; or
3838 (C) otherwise improving real property or a
3939 structure related to real property.
4040 (7) "Governmental entity" means:
4141 (A) this state; and
4242 (B) a political subdivision of this state,
4343 including a municipality, county, public school district, or
4444 special-purpose district or authority.
4545 (8) "Subcontractor" means a person, firm, or
4646 corporation contracting with a contractor for general
4747 construction.
4848 (b) To the extent consistent with federal law, a
4949 governmental entity that enters into a construction contract must
5050 require that the contractor ensure that all employees working on
5151 the general construction site that is the subject of the
5252 construction contract have completed construction safety training.
5353 Before an employee works on the general construction site, the
5454 contractor must receive and provide to the governmental entity a
5555 certificate of training completion for the employee.
5656 (c) To the extent consistent with federal law, a
5757 governmental entity that enters into a construction contract must
5858 require that the contractor ensure that at least one supervisor
5959 working on the general construction site that is the subject of the
6060 construction contract has completed advanced construction safety
6161 training. Before work begins on the general construction site, the
6262 contractor must receive from at least one supervisor a certificate
6363 of training completion and provide the certificate to the
6464 governmental entity.
6565 (d) A governmental entity that enters into a construction
6666 contract shall include in the contract notice and penalty
6767 provisions that:
6868 (1) require the governmental entity to provide the
6969 contractor with written notice, hand delivered or by certified
7070 mail, of a violation of Subsection (b) or (c) by the contractor;
7171 (2) require the contractor to comply with Subsection
7272 (b) or (c), as applicable, by the 20th day after the date the
7373 contractor receives any notice of noncompliance;
7474 (3) inform a contractor that the governmental entity
7575 may impose an administrative penalty if the contractor fails to
7676 comply with Subsection (b) or (c), as applicable, after the 20th day
7777 after the date the contractor receives any notice of noncompliance;
7878 and
7979 (4) explain that a penalty amount may be withheld from
8080 a payment otherwise owed to the contractor under the construction
8181 contract.
8282 (e) The amount of a penalty imposed under Subsection (d)(3)
8383 is $100 per day for each employee working in noncompliance.
8484 (f) Each governmental entity shall develop procedures for
8585 the administration of this section.
8686 SECTION 2. Section 2252.902, Government Code, as added by
8787 this Act, applies only to a contract for which the solicitation of
8888 qualifications, proposals, or other similar expressions of
8989 interest is published on or after September 1, 2017.
9090 SECTION 3. This Act takes effect September 1, 2017.
