A BILL TO BE ENTITLED
AN ACT
relating to an offense report prepared in the investigation of
certain criminal cases.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Chapter 2, Code of Criminal Procedure, is
amended by adding Article 2.1397 to read as follows:
Art. 2.1397. OFFENSE REPORT: RESISTING OR EVADING ARREST.
An offense report prepared in the investigation of a criminal case
in which a person is alleged to have resisted or evaded arrest under
Section 38.03 or 38.04, Penal Code, must state the underlying
offense for which the person was resisting or evading arrest.
SECTION 2. The change in law made by this Act applies only
to an offense report prepared on or after the effective date of this
Act.
SECTION 3. This Act takes effect September 1, 2017.
