| 10 | 10 | SECTION 1. Chapter 2, Code of Criminal Procedure, is | |
| 11 | 11 | amended by adding Article 2.1397 to read as follows: | |
| 12 | 12 | Art. 2.1397. OFFENSE REPORT: RESISTING OR EVADING ARREST. | |
| 13 | 13 | An offense report prepared in the investigation of a criminal case | |
| 14 | 14 | in which a person is alleged to have resisted or evaded arrest under | |
| 15 | 15 | Section 38.03 or 38.04, Penal Code, must state the underlying | |
| 16 | 16 | offense for which the person was resisting or evading arrest. | |
| 17 | 17 | SECTION 2. The change in law made by this Act applies only | |
| 18 | 18 | to an offense report prepared on or after the effective date of this | |
| 19 | 19 | Act. | |
| 20 | 20 | SECTION 3. This Act takes effect September 1, 2017. |
