55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the punishment for burglary and theft of controlled
88 substances.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 30.01, Penal Code, is amended by adding
1111 Subdivision (4) to read as follows:
1212 (4) "Controlled substance" has the meaning assigned by
1313 Section 481.002, Health and Safety Code.
1414 SECTION 2. Section 30.02, Penal Code, is amended by
1515 amending Subsection (c) and adding Subsection (c-1) to read as
1616 follows:
1717 (c) Except as provided in Subsection (c-1) or (d), an
1818 offense under this section is a:
1919 (1) state jail felony if committed in a building other
2020 than a habitation; or
2121 (2) felony of the second degree if committed in a
2222 habitation.
2323 (c-1) An offense under this section is a felony of the third
2424 degree if:
2525 (1) the premises are a building in which a controlled
2626 substance is generally stored, including a pharmacy, clinic,
2727 hospital, or nursing facility; and
2828 (2) the person entered or remained concealed in that
2929 building with intent to commit a theft of a controlled substance.
3030 SECTION 3. Section 31.03(e), Penal Code, is amended to read
3131 as follows:
3232 (e) Except as provided by Subsection (f), an offense under
3333 this section is:
3434 (1) a Class C misdemeanor if the value of the property
3535 stolen is less than $100;
3636 (2) a Class B misdemeanor if:
3737 (A) the value of the property stolen is $100 or
3838 more but less than $750;
3939 (B) the value of the property stolen is less than
4040 $100 and the defendant has previously been convicted of any grade of
4141 theft; or
4242 (C) the property stolen is a driver's license,
4343 commercial driver's license, or personal identification
4444 certificate issued by this state or another state;
4545 (3) a Class A misdemeanor if the value of the property
4646 stolen is $750 or more but less than $2,500;
4747 (4) a state jail felony if:
4848 (A) the value of the property stolen is $2,500 or
4949 more but less than $30,000, or the property is less than 10 head of
5050 sheep, swine, or goats or any part thereof under the value of
5151 $30,000;
5252 (B) regardless of value, the property is stolen
5353 from the person of another or from a human corpse or grave,
5454 including property that is a military grave marker;
5555 (C) the property stolen is a firearm, as defined
5656 by Section 46.01;
5757 (D) the value of the property stolen is less than
5858 $2,500 and the defendant has been previously convicted two or more
5959 times of any grade of theft;
6060 (E) the property stolen is an official ballot or
6161 official carrier envelope for an election; or
6262 (F) the value of the property stolen is less than
6363 $20,000 and the property stolen is:
6464 (i) aluminum;
6565 (ii) bronze;
6666 (iii) copper; or
6767 (iv) brass;
6868 (5) a felony of the third degree if the value of the
6969 property stolen is $30,000 or more but less than $150,000, or the
7070 property is:
7171 (A) cattle, horses, or exotic livestock or exotic
7272 fowl as defined by Section 142.001, Agriculture Code, stolen during
7373 a single transaction and having an aggregate value of less than
7474 $150,000; [or]
7575 (B) 10 or more head of sheep, swine, or goats
7676 stolen during a single transaction and having an aggregate value of
7777 less than $150,000; or
7878 (C) a controlled substance, regardless of the
7979 value of the controlled substance stolen;
8080 (6) a felony of the second degree if:
8181 (A) the value of the property stolen is $150,000
8282 or more but less than $300,000; or
8383 (B) the value of the property stolen is less than
8484 $300,000 and the property stolen is an automated teller machine or
8585 the contents or components of an automated teller machine; or
8686 (7) a felony of the first degree if the value of the
8787 property stolen is $300,000 or more.
8888 SECTION 4. Section 31.03(h), Penal Code, is amended by
8989 adding Subdivision (5) to read as follows:
9090 (5) "Controlled substance" has the meaning assigned by
9191 Section 481.002, Health and Safety Code.
9292 SECTION 5. The change in law made by this Act applies only
9393 to an offense committed on or after the effective date of this Act.
9494 An offense committed before the effective date of this Act is
9595 governed by the law in effect on the date the offense was committed,
9696 and the former law is continued in effect for that purpose. For
9797 purposes of this section, an offense was committed before the
9898 effective date of this Act if any element of the offense occurred
9999 before that date.
100100 SECTION 6. This Act takes effect September 1, 2017.
