64 AN ACT
75 relating to required training for veterans county service officers
86 and assistant veterans county service officers.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Sections 434.038(a), (b), (c), and (e),
119 Government Code, are amended to read as follows:
1210 (a) An officer shall, within the time after the date of the
1311 officer's appointment that the commission prescribes, complete a
1412 course of initial training provided by the Texas Veterans
1513 Commission or approved under Subsection (e)(5). The commission
1614 shall issue the officer a certificate of training after completion
1715 of all [the] initial training requirements established by the
1816 commission under this section [course]. To maintain certification,
1917 the officer shall complete continuing training [to the extent]
2018 required by the commission that is approved under Subsection (e)(5)
2119 or provided by the commission. An officer must maintain
2220 certification to remain in office.
2321 (b) The commission may [shall] provide, at commission
2422 expense, the initial and continuing training required by this
2523 section at least once each year. If state funds are appropriated
2624 for that purpose, the commission shall reimburse an officer's
2725 travel and lodging expenses incurred in attending training provided
2826 by the commission. The commission shall make the reimbursement in
2927 the manner prescribed for the reimbursement of these expenses to
3028 state employees.
3129 (c) The commissioners court of an officer's county shall
3230 reimburse an officer's travel and lodging expenses incurred in
3331 attending [commission] training required under this section that is
3432 approved under Subsection (e)(5) [unless state funds are
3533 appropriated for that purpose. If state funds are appropriated,
3634 the commission shall make the reimbursement in the manner
3735 prescribed for the reimbursement of these expenses to state
3836 employees].
3937 (e) The commission shall:
4038 (1) maintain course materials and examinations in a
4139 central location and provide county service offices and commission
4240 field staff with access to the course materials on the commission's
4341 Internet website;
4442 (2) regularly update course materials, training
4543 curriculum, and examinations after consulting with:
4644 (A) the United States Department of Veterans
4745 Affairs to ensure the course materials, training curriculum, and
4846 examinations are accurate and meet applicable United States
4947 Department of Veterans Affairs requirements; and
5048 (B) accredited county service officers to ensure
5149 the materials, training curriculum, and examinations include
5250 issues developing at the county level;
5351 (3) develop a training handbook containing
5452 instruction and case studies addressing:
5553 (A) general assistance techniques, including how
5654 to provide general information regarding state and federal benefits
5755 and referrals for other services and to other agencies, and general
5856 information regarding state and federal benefits;
5957 (B) basic counseling approaches for assisting
6058 veterans, their family members, and other eligible dependents
6159 filing benefit claims;
6260 (C) basic information on United States
6361 Department of Veterans Affairs processes and procedures, including
6462 how to accurately complete claims and appeals forms and how to
6563 support claims;
6664 (D) methods of collecting required documentation
6765 and developing claims and appeals;
6866 (E) methods of documenting progress and updating
6967 a veteran's, a veteran's family member's, or another eligible
7068 dependent's case information;
7169 (F) methods of assisting veterans, their family
7270 members, or other eligible dependents in pursuing appeals,
7371 including offering case knowledge in appeals hearings; and
7472 (G) methods of representing veterans, their
7573 family members, or other eligible dependents during appeals
7674 hearings; [and]
7775 (4) coordinate with the Department of State Health
7876 Services to incorporate a suicide prevention component as part of
7977 the accreditation training and examination; and
8078 (5) approve training provided by public or private
8179 entities to fulfill initial and continuing training requirements
8280 established by the commission under this section.
8381 SECTION 2. This Act takes effect September 1, 2017.
