64 AN ACT
75 relating to the quality of water provided by public drinking water
86 supply systems to state supported living centers.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Subchapter B, Chapter 555, Health and Safety
119 Code, is amended by adding Section 555.026 to read as follows:
1210 Sec. 555.026. DRINKING WATER QUALITY: TEXAS COMMISSION ON
1311 ENVIRONMENTAL QUALITY GUIDANCE ON LEAD AND COPPER TESTING. To
1412 ensure the quality of water provided by public drinking water
1513 supply systems to state supported living centers, the department or
1614 its successor agency, with guidance from the Texas Commission on
1715 Environmental Quality, shall:
1816 (1) develop:
1917 (A) a testing plan and monitoring strategy;
2018 (B) outreach and educational materials for
2119 distribution to residents and department staff;
2220 (C) requirements for using an accredited
2321 laboratory and sample chain of custody procedures; and
2422 (D) guidance for compliance with the federal lead
2523 and copper rules (40 C.F.R. Part 141, Subpart I);
2624 (2) review:
2725 (A) public notification procedures to staff,
2826 residents, and visitors regarding water quality;
2927 (B) sampling protocols and procedures;
3028 (C) locations of taps used for monitoring;
3129 (D) analytical data on lead or copper levels
3230 exceeding the applicable action level;
3331 (E) remediation activities; and
3432 (F) customer service inspection reports;
3533 (3) compile a list of qualified customer service
3634 inspectors; and
3735 (4) perform:
3836 (A) on-site training and evaluation of sampling;
3937 and
4038 (B) on-site evaluation of customer service
4139 inspections through licensed customer service inspectors.
4240 SECTION 2. This Act takes effect immediately if it receives
4341 a vote of two-thirds of all the members elected to each house, as
4442 provided by Section 39, Article III, Texas Constitution. If this
4543 Act does not receive the vote necessary for immediate effect, this
4644 Act takes effect September 1, 2017.
