9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 8 | | SECTION 1. Subchapter B, Chapter 555, Health and Safety |
---|
11 | 9 | | Code, is amended by adding Section 555.026 to read as follows: |

12 | 10 | | Sec. 555.026. DRINKING WATER QUALITY: TEXAS COMMISSION ON |
---|
13 | 11 | | ENVIRONMENTAL QUALITY GUIDANCE ON LEAD AND COPPER TESTING. To |
---|
14 | 12 | | ensure the quality of water provided by public drinking water |
---|
15 | 13 | | supply systems to state supported living centers, the department or |
---|
16 | 14 | | its successor agency, with guidance from the Texas Commission on |
---|
17 | 15 | | Environmental Quality, shall: |
---|
18 | 16 | | (1) develop: |
---|
19 | 17 | | (A) a testing plan and monitoring strategy; |
---|
20 | 18 | | (B) outreach and educational materials for |
---|
21 | 19 | | distribution to residents and department staff; |
---|
22 | 20 | | (C) requirements for using an accredited |
---|
23 | 21 | | laboratory and sample chain of custody procedures; and |
---|
24 | 22 | | (D) guidance for compliance with the federal lead |
---|
25 | 23 | | and copper rules (40 C.F.R. Part 141, Subpart I); |
---|
26 | 24 | | (2) review: |
---|
27 | 25 | | (A) public notification procedures to staff, |
---|
28 | 26 | | residents, and visitors regarding water quality; |
---|
29 | 27 | | (B) sampling protocols and procedures; |
---|
30 | 28 | | (C) locations of taps used for monitoring; |
---|
31 | 29 | | (D) analytical data on lead or copper levels |
---|
32 | 30 | | exceeding the applicable action level; |
---|
33 | 31 | | (E) remediation activities; and |
---|
34 | 32 | | (F) customer service inspection reports; |
---|
35 | 33 | | (3) compile a list of qualified customer service |
---|
36 | 34 | | inspectors; and |
---|
37 | 35 | | (4) perform: |
---|
38 | 36 | | (A) on-site training and evaluation of sampling; |
---|
39 | 37 | | and |
---|
40 | 38 | | (B) on-site evaluation of customer service |
---|
41 | 39 | | inspections through licensed customer service inspectors. |
---|
42 | 40 | | SECTION 2. This Act takes effect immediately if it receives |
---|
43 | 41 | | a vote of two-thirds of all the members elected to each house, as |
---|
44 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
45 | 43 | | Act does not receive the vote necessary for immediate effect, this |
---|
46 | 44 | | Act takes effect September 1, 2017. |
