| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 75.0022(b), Civil Practice and Remedies | |
| 12 | 12 | Code, is amended to read as follows: | |
| 13 | 13 | (b) This section applies only to an electric utility located | |
| 14 | 14 | in: | |
| 15 | 15 | (1) a county with a population of four million or more; | |
| 16 | 16 | or | |
| 17 | 17 | (2) a county with a population of 550,000 or more that | |
| 18 | 18 | is adjacent to a county described by Subdivision (1). | |
| 19 | 19 | SECTION 2. The change in law made by this Act applies only | |
| 20 | 20 | to a cause of action that accrues on or after the effective date of | |
| 21 | 21 | this Act. A cause of action that accrues before the effective date | |
| 22 | 22 | of this Act is governed by the law in effect immediately before that | |
| 23 | 23 | date, and that law is continued in effect for that purpose. | |
| 24 | 24 | SECTION 3. This Act takes effect immediately if it receives | |
| 25 | 25 | a vote of two-thirds of all the members elected to each house, as | |
| 26 | 26 | provided by Section 39, Article III, Texas Constitution. If this | |
| 27 | 27 | Act does not receive the vote necessary for immediate effect, this | |
| 28 | 28 | Act takes effect September 1, 2017. |
