| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter C, Chapter 361, Health and Safety | |
| 11 | 11 | Code, is amended by adding Section 361.0681 to read as follows: | |
| 12 | 12 | Sec. 361.0681. RETURN OR DENIAL OF INCOMPLETE OR INACCURATE | |
| 13 | 13 | APPLICATION. (a) Before the commission determines that a permit | |
| 14 | 14 | application is administratively and technically complete, the | |
| 15 | 15 | commission may return the application to an applicant if the | |
| 16 | 16 | application is incomplete or inaccurate. | |
| 17 | 17 | (b) The commission: | |
| 18 | 18 | (1) shall deny a permit application the commission | |
| 19 | 19 | finds to be incomplete or inaccurate during technical review if the | |
| 20 | 20 | commission returned a previous version of the application to the | |
| 21 | 21 | applicant during technical review because the previous version was | |
| 22 | 22 | incomplete or inaccurate; and | |
| 23 | 23 | (2) may not approve a subsequent application for a | |
| 24 | 24 | solid waste facility at the site that was the subject of the denied | |
| 25 | 25 | application under Subdivision (1). | |
| 26 | 26 | SECTION 2. The changes in law made by this Act apply only to | |
| 27 | 27 | an application for the issuance of a permit pending before the Texas | |
| 28 | 28 | Commission on Environmental Quality on or after the effective date | |
| 29 | 29 | of this Act. | |
| 30 | 30 | SECTION 3. This Act takes effect September 1, 2017. |
