55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the definition of commercial property insurance for
88 purposes of certain provisions governing insurance rates and policy
99 forms.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2251.002, Insurance Code, is amended by
1212 amending Subdivision (1) and adding Subdivision (1-a) to read as
1313 follows:
1414 (1) "Commercial property insurance" means insurance
1515 coverage against loss caused by or resulting from loss, damage, or
1616 destruction of real or personal property provided through a
1717 commercial property insurance policy. The term includes any
1818 combination of:
1919 (A) commercial fire or allied lines;
2020 (B) commercial inland marine insurance;
2121 (C) commercial crime coverage;
2222 (D) boiler and machinery insurance other than
2323 explosion;
2424 (E) glass insurance provided as part of other
2525 coverage; and
2626 (F) as authorized by commissioner rule,
2727 insurance covering other perils or providing other coverages or
2828 other lines of first party property insurance.
2929 (1-a) "Disallowed expenses" includes:
3030 (A) administrative expenses, other than
3131 acquisition, loss control, and safety engineering expenses, that
3232 exceed 110 percent of the industry median for those expenses;
3333 (B) lobbying expenses;
3434 (C) advertising expenses, other than for
3535 advertising:
3636 (i) directly related to the services or
3737 products provided by the insurer; or
3838 (ii) designed and directed at loss
3939 prevention;
4040 (D) amounts paid by an insurer:
4141 (i) as damages in an action brought against
4242 the insurer for bad faith, fraud, or any matters other than payment
4343 under the insurance contract; or
4444 (ii) as fees, fines, penalties, or
4545 exemplary damages for a civil or criminal violation of law;
4646 (E) contributions to:
4747 (i) social, religious, political, or
4848 fraternal organizations; or
4949 (ii) organizations engaged in legislative
5050 advocacy;
5151 (F) except as authorized by commissioner rule,
5252 fees and assessments paid to advisory organizations;
5353 (G) any amount determined by the commissioner to
5454 be excess premiums charged by the insurer; and
5555 (H) any unreasonably incurred expenses, as
5656 determined by the commissioner after notice and hearing.
5757 SECTION 2. Section 2301.002, Insurance Code, is amended by
5858 amending Subdivision (1) and adding Subdivision (1-a) to read as
5959 follows:
6060 (1) "Commercial property insurance" means insurance
6161 coverage against loss caused by or resulting from loss, damage, or
6262 destruction of real or personal property provided through a
6363 commercial property insurance policy. The term includes any
6464 combination of:
6565 (A) commercial fire or allied lines;
6666 (B) commercial inland marine insurance;
6767 (C) commercial crime coverage;
6868 (D) boiler and machinery insurance other than
6969 explosion;
7070 (E) glass insurance provided as part of other
7171 coverage; and
7272 (F) as authorized by commissioner rule,
7373 insurance covering other perils or providing other coverages or
7474 other lines of first party property insurance.
7575 (1-a) "Form" means an insurance policy form or a
7676 printed endorsement form.
7777 SECTION 3. This Act takes effect immediately if it receives
7878 a vote of two-thirds of all the members elected to each house, as
7979 provided by Section 39, Article III, Texas Constitution. If this
8080 Act does not receive the vote necessary for immediate effect, this
8181 Act takes effect September 1, 2017.
