75 relating to the applicability of open meetings requirements to
86 certain meetings of a governing body relating to information
97 technology security practices.
108 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
119 SECTION 1. Section 551.089, Government Code, is amended to
1210 read as follows:
1311 Sec. 551.089. DELIBERATION REGARDING SECURITY DEVICES OR
1412 SECURITY AUDITS; CLOSED MEETING [DEPARTMENT OF INFORMATION
1513 RESOURCES]. This chapter does not require a governmental body [the
1614 governing board of the Department of Information Resources] to
1715 conduct an open meeting to deliberate:
1816 (1) security assessments or deployments relating to
1917 information resources technology;
2018 (2) network security information as described by
2119 Section 2059.055(b); or
2220 (3) the deployment, or specific occasions for
2321 implementation, of security personnel, critical infrastructure, or
2422 security devices.
2523 SECTION 2. Section 2059.055(b), Government Code, is amended
2624 to read as follows:
2725 (b) Network security information is confidential under this
2826 section if the information is:
2927 (1) related to passwords, personal identification
3028 numbers, access codes, encryption, or other components of the
3129 security system of a governmental entity [state agency];
3230 (2) collected, assembled, or maintained by or for a
3331 governmental entity to prevent, detect, or investigate criminal
3432 activity; or
3533 (3) related to an assessment, made by or for a
3634 governmental entity or maintained by a governmental entity, of the
3735 vulnerability of a network to criminal activity.
3836 SECTION 3. This Act takes effect September 1, 2017.
