| 10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 9 | | SECTION 1. Section 551.089, Government Code, is amended to |
|---|
| 12 | 10 | | read as follows: |
|---|
| 13 | 11 | | Sec. 551.089. DELIBERATION REGARDING SECURITY DEVICES OR |
|---|
| 14 | 12 | | SECURITY AUDITS; CLOSED MEETING [DEPARTMENT OF INFORMATION |
|---|
| 15 | 13 | | RESOURCES]. This chapter does not require a governmental body [the |
|---|
| 16 | 14 | | governing board of the Department of Information Resources] to |
|---|
| 17 | 15 | | conduct an open meeting to deliberate: |
|---|
| 18 | 16 | | (1) security assessments or deployments relating to |
|---|
| 19 | 17 | | information resources technology; |
|---|
| 20 | 18 | | (2) network security information as described by |
|---|
| 21 | 19 | | Section 2059.055(b); or |
|---|
| 22 | 20 | | (3) the deployment, or specific occasions for |
|---|
| 23 | 21 | | implementation, of security personnel, critical infrastructure, or |
|---|
| 24 | 22 | | security devices. |
|---|
| 25 | 23 | | SECTION 2. Section 2059.055(b), Government Code, is amended |
|---|
| 26 | 24 | | to read as follows: |
|---|
| 27 | 25 | | (b) Network security information is confidential under this |
|---|
| 28 | 26 | | section if the information is: |
|---|
| 29 | 27 | | (1) related to passwords, personal identification |
|---|
| 30 | 28 | | numbers, access codes, encryption, or other components of the |
|---|
| 31 | 29 | | security system of a governmental entity [state agency]; |
|---|
| 32 | 30 | | (2) collected, assembled, or maintained by or for a |
|---|
| 33 | 31 | | governmental entity to prevent, detect, or investigate criminal |
|---|
| 34 | 32 | | activity; or |
|---|
| 35 | 33 | | (3) related to an assessment, made by or for a |
|---|
| 36 | 34 | | governmental entity or maintained by a governmental entity, of the |
|---|
| 37 | 35 | | vulnerability of a network to criminal activity. |
|---|
| 38 | 36 | | SECTION 3. This Act takes effect September 1, 2017. |
