94 A BILL TO BE ENTITLED
105 AN ACT
116 relating to the qualifications for a person conducting an adoption
127 evaluation.
138 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
149 SECTION 1. Section 107.154(b), Family Code, is amended to
1510 read as follows:
1611 (b) To be qualified to conduct an adoption evaluation under
1712 this subchapter, a person must:
1813 (1) have a degree from an accredited college or
1914 university in a human services field of study and a license to
2015 practice in this state as a social worker, professional counselor,
2116 marriage and family therapist, or psychologist and:
2217 (A) have one year of full-time experience working
2318 at a child-placing agency conducting child-placing activities; or
2419 (B) be practicing under the direct supervision of
2520 a person qualified under this section to conduct adoption
2621 evaluations;
2722 (2) be employed by or under contract with a domestic
2823 relations office, provided that the person conducts adoption
2924 evaluations relating only to families ordered to participate in
3025 adoption evaluations conducted by the domestic relations office; or
3126 (3) be qualified as a child custody evaluator under
3227 Section 107.104.
3328 SECTION 2. The change in law made by this Act applies only
3429 to an adoption evaluation conducted on or after the effective date
3530 of this Act. An adoption evaluation conducted before the effective
3631 date of this Act is governed by the law in effect on the date the
3732 evaluation was conducted, and the former law is continued in effect
3833 for that purpose.
3934 SECTION 3. This Act takes effect September 1, 2017.
