13 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

14 | 9 | | SECTION 1. Section 107.154(b), Family Code, is amended to |
---|
15 | 10 | | read as follows: |
---|
16 | 11 | | (b) To be qualified to conduct an adoption evaluation under |
---|
17 | 12 | | this subchapter, a person must: |
---|
18 | 13 | | (1) have a degree from an accredited college or |
---|
19 | 14 | | university in a human services field of study and a license to |
---|
20 | 15 | | practice in this state as a social worker, professional counselor, |
---|
21 | 16 | | marriage and family therapist, or psychologist and: |
---|
22 | 17 | | (A) have one year of full-time experience working |
---|
23 | 18 | | at a child-placing agency conducting child-placing activities; or |
---|
24 | 19 | | (B) be practicing under the direct supervision of |
---|
25 | 20 | | a person qualified under this section to conduct adoption |
---|
26 | 21 | | evaluations; |
---|
27 | 22 | | (2) be employed by or under contract with a domestic |
---|
28 | 23 | | relations office, provided that the person conducts adoption |
---|
29 | 24 | | evaluations relating only to families ordered to participate in |
---|
30 | 25 | | adoption evaluations conducted by the domestic relations office; or |
---|
31 | 26 | | (3) be qualified as a child custody evaluator under |
---|
32 | 27 | | Section 107.104. |
---|
33 | 28 | | SECTION 2. The change in law made by this Act applies only |
---|
34 | 29 | | to an adoption evaluation conducted on or after the effective date |
---|
35 | 30 | | of this Act. An adoption evaluation conducted before the effective |
---|
36 | 31 | | date of this Act is governed by the law in effect on the date the |
---|
37 | 32 | | evaluation was conducted, and the former law is continued in effect |
---|
38 | 33 | | for that purpose. |
---|
39 | 34 | | SECTION 3. This Act takes effect September 1, 2017. |
